No persons shall drink any alcoholic beverages
or have in their possession any open alcoholic beverages, as defined
in MGL c. 138, § 1, in or upon any public way or upon any
way to which the public has a right of access, or any place which
members of the public have access as invitees or licensees, in any
park or playground or private land or place without the consent of
the owner or person in control thereof.
Any person found drinking in such public place
shall be arrested and prosecuted according to law.
All alcoholic beverages used in violation of
this article shall be seized and held until final disposition of the
charge against the person or persons arrested have been made in a
court of law. The court shall make such order as it deems fit for
the return of any which is seized, except any portion of the beverages
used for the purposes of analysis.
