All employees are hereby notified that the unlawful manufacture, distribution,
dispensing, possession or use of a controlled substance is prohibited in the
Town of Orchard Park's workplace(s).
As a condition of employment, each employee engaged in the performance
of duties will:
A. Abide by the terms of this chapter.
B. Notify the town of any criminal drug statute conviction
for a violation occurring in the workplace no later than five days after such
conviction.
Employees seeking information about the dangers of drug abuse in the
workplace and/or the availability of drug counseling, rehabilitation and employee
assistance programs are directed to contact the Town Supervisor.
If an employee is found to have violated this chapter, the employee
will be questioned by a committee which will include representatives from
the Town of Orchard Park and the employee's department and, if appropriate,
a union representative from the Civil Service Employees' Association.
The town may impose penalties on employees for drug abuse violations
occurring in the workplace, including:
A. Personnel actions as allowed under any applicable collective
bargaining agreement of the Town of Orchard Park, up to and including termination.
B. Requiring such employee to participate satisfactorily
in a drug abuse assistance or rehabilitation program approved for such purposes
by federal, state or local health, law enforcement or other appropriate agency.
The town shall, within 30 days of receiving notice that an employee has been convicted of a violation of a criminal drug statute occurring in the workplace, take one of the actions against the employee as provided in §
9-5A or
B above.
