As used in this chapter, the following terms
shall have the meanings indicated:
The principal building or buildings on each lot and not including
any minor building.
The Town Building Inspector is hereby authorized
to decide which building or buildings on any particular lot shall
be numbered.
It shall be the duty of every owner of a building
in the Town to cause to be displayed thereon the street number of
said building and at all times to maintain such number in compliance
with the provisions of this chapter.
A.
The
figure or figures comprising the number to be displayed on a building
shall be at least four inches in height with a minimum stroke width
of 0.5 inch. They shall be placed on the front of said building in
a prominent and conspicuous place and in such manner as to be plainly
legible from the center of the street at all times between sunrise
and sunset. The color of such figures shall be in sharp contrast to
the color of their background.

B.
The numbers shall be so placed that they will not
be obstructed by trees, shrubbery, porches or other extensions of
the building.
C.
Wherever practicable, said number shall be placed
near some light or source of illumination so that it may be readily
seen at night.
D.
Where the building upon which the number is to be
displayed is more than 75 feet from the edge of the right-of-way of
the street or road serving the building, the number shall, in addition
to the other requirements of this section, be displayed on a sign
readily visible from the road or street and in no event further back
than 25 feet from the road or street right-of-way.
Each separate building or dwelling shall be
assigned a separate distinguishing number by the Town Board in conformity
with a uniform numbering system encompassing the entire Town. The
display of any house number other than the number assigned by the
Town is expressly prohibited.
A.
Noncompliance deemed a violation. Any person owning
a building within the Town of Orchard Park outside of the corporate
limits of the Village of Orchard Park, refusing or neglecting for
60 days after notice from the Town Building Inspector to place the
proper designated number on said building, shall be guilty of a violation
of this chapter.
B.
Service of notice. The notice provided for in Subsection A may be given by personal service or by mailing a copy thereof to the last known address of the owner.
C.
Numbering of building by Town. In the event of the
neglect or refusal of any owner after notice to cause said building
to be properly numbered, the Superintendent of Highways of the Town,
upon being advised by the Building Inspector, may cause said building
to be properly numbered.
D.
Report, assessment of costs. The Superintendent of
Highways shall report the cost of numbering said building to the Town
Board, and such Board shall order the Assessor to assess the cost
of the same upon such premises and the Assessor shall include the
same in the assessment role.

Violations of this chapter shall be punishable
by a maximum fine of $250 or by imprisonment for not more than 15
days, or both.
