Pursuant to the authority conferred by Article
16 of the Town Law of the State of New York and for each of the purposes
specified therein, the Town Board of the Town of Orchard Park, County
of Erie and State of New York, has ordained and does hereby enact
this chapter regulating and restricting the location, size and use
of buildings and other structures and the use of land in the Town
of Orchard Park, outside the corporation limits of the Village of
Orchard Park.
This chapter shall be known and cited as the
"Town of Orchard Park Zoning Ordinance."
The intent of this chapter is to establish comprehensive
controls for the development of land in the Town of Orchard Park,
based on the general plan for the town and enacted in order to promote
and protect the health, safety, comfort, convenience and the general
welfare of the people.
Such regulations shall be made in accordance
with the general plan and designed to lessen congestion in the streets;
to secure safety from fires, flood, panic and other dangers; to promote
the health and general welfare; to provide adequate light and air;
to prevent overcrowding of land; to facilitate the provision of transportation,
water, sewerage, schools, parks and other public requirements. Such
regulations shall be made with reasonable consideration, among other
things, to the characteristics of the district and its peculiarities
for particular uses and with a view to conserving the value of buildings
and encouraging the most appropriate use of land throughout the town.
