It shall be unlawful to place, deposit or permit
to be deposited in an unsanitary manner upon public or private property
within the Town of LaGrange or in any area under the jurisdiction
of said Town any human or animal excrement, garbage or other objectionable
waste.
It shall be unlawful to discharge to any natural outlet within the Town of LaGrange or in any area under the jurisdiction of said Town any sanitary sewage, industrial wastes or other polluted waters except where suitable treatment has been provided in accordance with the subsequent provisions of this Part
1 of this chapter, the Public Health Law and the regulations of the New York State Department of Health and the Dutchess County Health Department.
Except as hereinafter provided, it shall be
unlawful to construct or maintain any privy, privy vault, septic tank,
cesspool or other facility intended or used for the disposal of sewage.
The owners of all houses, buildings or property used for human occupancy, employment, recreation or other purposes, situated within the Town and abutting on any street, alley or right-of-way in which there is now located or may in the future be located a public sanitary sewer of the Town, are hereby required, at their expense, to install suitable toilets and facilities therein and to connect such facilities directly with the proper public sewer in accordance with the provisions of this Part
1 of this chapter within 90 days after the date of official notice to do so, provided that said public sewer is within 150 feet of the property line.
The owners of property being developed as a
subdivision having plot sizes of less than one acre per dwelling unit
shall construct such sewers and appurtenances thereto as are shown
on the map or plat and the plans, profiles and drawings accompanying
said plat, approved by the Dutchess County Health Department and the
Engineer and filed in the office of the Planning Board of the Town
of LaGrange. Such sewers shall be constructed in accordance with the
specifications contained in or referred to in the rules and regulations
of the said Planning Board, the Dutchess County Health Department
and the Town. The plans, drawings and design shall be approved by
the Engineer.
The owners of property being developed into
multiple dwellings, commercial installations, industrial sites, public
gathering places, schools and offices shall construct such building
drains and building sewers as shown on the map or plat, approved by
the Dutchess County Health Department and the Engineer and conforming
to the requirements and specifications of the Town.
No portion of this article shall be construed
to interfere with or modify the requirements of design, inspection
and approval which are imposed by the appropriate health officials
and the State and County Health Departments.
