Where a public sanitary sewer system is not available under the provisions of §
187-6, the building drain shall be connected to a private subsurface sewage disposal system complying with the provisions of this article.
The type of private sewage disposal system shall
comply with all requirements of the Dutchess County Health Department
and the Town.
At such time as a public sewer system becomes available to a property served by a private sewage disposal system as provided in §
187-6, a direct connection shall be made to the public sewer in compliance with this Part
1 of this chapter, and any septic tank and cesspools and similar private disposal facilities shall be abandoned and filled with suitable material.
Before commencement of construction of a private
sewage disposal system, the owner shall first obtain written approval
of the County Health Department and of the Engineer or his designated
representative. All tests to determine the percolation rate to be
used for design of subsurface disposal systems shall be made by the
Engineer, who shall designate the minimum installation required for
each system.

A. A permit
issued by the Department of Public Works shall be required for the
installation of private sewage disposal systems. The permit fee shall
be set forth on the prevailing fee schedule adopted by resolution
of the Town Board and as such schedule is modified from time to time
by resolution of the Town Board.
B. A permit
for private sewage disposal systems shall not become effective until
the installation is completed to the satisfaction of the Engineer
or his designated representative. The Engineer shall be allowed to
inspect the work at any stage of construction, and the applicant for
the permit shall notify the Engineer before any underground portions
are covered and when the work is ready for final inspection. The inspections
shall be made within 48 hours of the receipt of notice by the Engineer.
The owner shall operate and maintain the private
sewage disposal facilities in a sanitary manner at all times and at
no expense to the Town.
No statement contained in this article shall
be construed to interfere or conflict with any additional requirements
that may be imposed by the Dutchess County Health Department.
