This article is adopted pursuant to § 1640-a
of the Vehicle and Traffic Law of the State of New York at the requests
of owners of shopping centers in the Town of LaGrange, Dutchess County,
New York.
Any vehicle parked or abandoned in said fire
lanes during snowstorms, floods, fires or other public emergencies
shall be removed, upon the order of the Town Superintendent of Highways,
to the Town of LaGrange garage and may not be recovered except upon
payment to the Town Clerk for all expenses incurred in the removal
and storage of said vehicle by the owner or operator of same.
The violation of this article constitutes a
traffic infraction, and every person convicted of a traffic infraction
for a violation of this article shall be punishable by a fine of not
more than $50 or by imprisonment for not more than 15 days, or by
both such fine and imprisonment. For a second such conviction within
18 months thereafter, such persons shall be punished by a fine of
not more than $100 or by imprisonment for not more than 45 days, or
by both such fine and imprisonment. Upon a third or subsequent conviction
within 18 months after the first conviction, such person shall be
punished by a fine of not more than $250 or by imprisonment for not
more than 90 days, or by both such fine and imprisonment.
