There is hereby established the office of constable
for the Town of Monroe.

Constables shall be appointed by resolution
of the Town Board and shall serve at the pleasure of the Town Board.
The Town Board may appoint up to four constables at any one time.
Constables shall serve without compensation unless the Town Board,
by express resolution, determines otherwise.
A constable shall possess the following qualifications:

Any constable appointed under the authority
of this chapter shall not be a "peace officer," as that term is defined
in the Criminal Procedure Law, and shall be deemed to be a part-time
employee unless the Town Board, by resolution, specifically provides
otherwise.

Constables appointed under the authority of
this chapter shall have the power to provide service of civil process
or appearance tickets.
All constables shall be under the direction
of the Supervisor, unless otherwise resolved by the Town Board. Constables
shall also respond to the directions of other Town officers, made
in conjunction with the Supervisor, who shall be in need of their
services for service of civil process or appearance tickets.

No constable appointed under the authority of
this chapter shall carry or use a weapon during any phase of his official
duties.

This chapter shall take effect in the manner
prescribed by law, and no person heretofore appointed by the Town
Board as a constable, prior to the effective date thereof, shall continue
in such capacity unless specifically reappointed by the Town Board.
