The Town Board of the Town of Monroe determines that it is in the interest
of the public health, safety and welfare of the residents of the Town of Monroe
to establish rules and regulations for the public's use of dedicated
recreational vehicles areas within the unincorporated areas of the Town. It
is also the intent of this chapter to preserve the peace and good order of
the Town and to protect and preserve the public and private property of the
Town and its residents.
As used in this chapter, the following terms shall have the meanings
indicated:
PARKS
Dedicated recreational areas in the Town of Monroe, including all
parks, playgrounds, athletic fields, swimming pools, ponds, beaches and other
recreational areas, buildings and facilities being utilized by or under the
jurisdiction of the Town and any areas that may hereinafter be designated
by the Town Board.
TOWN
The unincorporated areas of the Town of Monroe.
No person shall be permitted in the parks of the Town of Monroe except
during daylight hours without the express written permission of the Town Board
of the Town of Monroe.
In all parks, the following acts are prohibited and no person shall:
A. Injure, deface or disturb any part of the park or any
building, sign, equipment or other property therein or remove, injure or destroy
any tree, flower, shrub, rock or other mineral found therein.
B. Interfere with any lamp, lamppost, or electric light
apparatus or extinguish the light therein except upon proper authority.
C. Set fire or assist another to set fire to any timber,
trees, shrubs, grass, leaves, growth or other combustible material in any
part of the park, except as otherwise provided herein.
D. Throw, cast, lay, drop, discharge, deposit, bring into
or leave in any part of the park any garbage, sewage, refuse, trash, waste
or other obnoxious material otherwise than in receptacles or pits provided
for such purpose.
E. Drive or ride any all-terrain vehicle or any recreational motor vehicle as those terms are defined in Chapter
52 of the Town Code except when being operated by employees of the Town of Monroe as part of their official duties.
F. Ride any horse or other animal.
G. Camp or erect or maintain a tent, shelter or camp except
as otherwise provided herein.
H. Use any park grounds for the purpose of a dog run, exercise
pen or cause such properties to be used for any animal's needs or bodily
functions.
I. Conduct himself/herself or cause others to behave in
a disorderly manner or cause discomfort or inconvenience to any other person
in the park.
J. Use any alcoholic beverage in any part of the park.
Notwithstanding §
34A-4D and
G of this chapter, organizations may apply to the Town Board for permission to use the parks for camping activities, including the building of campfires, provided such organizations can provide the Town with a certificate of liability insurance naming the Town as an additional insured and can demonstrate to the Town Board's satisfaction that such activities will be carefully monitored by responsible individuals. If an organization is approved by the Town Board to conduct such activities in the park, a written permit shall be issued by the Town Clerk.
Any person who shall be found guilty of a violation of this chapter
shall be subject to a fine of not more than $250 or by imprisonment for not
more than 15 days, or both.
