A. 
All industrial users shall file wastewater information with the Town as deemed necessary by the Sewer Administrator and village and as further described in this article for the determination of compliance with this chapter, the village SPDES permit and state and federal laws. Such information shall be provided by completion of a questionnaire supplied by the Sewer Administrator and supplements thereto as may be necessary. The time period for submission of the requested information shall be stated on the questionnaire, and failure to submit all requested information by the stipulated date will be a violation of this chapter unless prior written permission is obtained from the Sewer Administrator. The Sewer Administrator may request this information whenever it appears necessary for the enforcement of this chapter, the village SPDES permit and any state or federal laws.
B. 
Discharge monitoring reports.
(1) 
The Sewer Administrator will require discharge monitoring reports from any user at intervals as specified by the Sewer Administrator and village. In determining the need for these discharge reports and the specified intervals, the Sewer Administrator shall take into account the following items:
(a) 
Is the report necessary to determine compliance with pretreatment standards or this law?
(b) 
What will be the effect on the treatment system if the pretreatment standards are violated?
(c) 
Is the report necessary to determine the amount of excessive compatible pollutant being discharged either for estimation of charges or for determination of the impact of these discharges on the wastewater treatment system?
(d) 
Has the user demonstrated that the characteristics of the discharged wastewater are consistent?
(e) 
Does the user have a prior record of violation of this chapter or prior local laws or ordinances relating to sewer use?
(f) 
Is the user suspected of or does the user have the potential for violations of this chapter?
(g) 
Other factors relating to the enforcement of this chapter.
(2) 
The information required in discharge monitoring reports may include but shall not be limited to:
(a) 
The nature of the process.
(b) 
Flow volume (daily, weekly or annually).
(c) 
The time and duration of discharge.
(d) 
The average and peak wastewater discharge rates, including daily, monthly and seasonal variations, if any.
(e) 
Mass emission rates.
(f) 
Site plans, floor plans, mechanical and plumbing plans and details to show all sewers and appurtenances by size, location and elevation.
(g) 
A description of activities, facilities and plan process on the premises, including all materials, processes and types of materials which are or could be discharged.
(h) 
Each product produced by type, amount and rate of production.
(i) 
The number and type of employees and hours of work.
(j) 
Wastewater constituents and characteristics.
(k) 
Other information which relates to the generation of waste.
(l) 
Records of pretreatment data such as chemicals added or dates and method of cleaning and disposing of grease from grease interceptors.
(3) 
Such reports may also include the chemical constituents and quantity of liquid or gaseous materials stored on site even though they may not normally be discharged. The Sewer Administrator will evaluate the data furnished by the user. Additional information shall be supplied as required by the Sewer Administrator and village.
C. 
Compliance with pretreatment requirements. Persons required to pretreat wastewater shall, along with their discharge report, provide a statement reviewed by a qualified authorized representative of the user certifying under penalty of perjury that applicable pretreatment requirements are being met on a consistent basis and, if not, describing the additional operation and maintenance or additional pretreatment required for the user to meet the pretreatment requirements. If additional pretreatment or operation and maintenance will be required to meet the pretreatment requirements, the user shall submit a plan (including schedules) to the Sewer Administrator, who shall in turn submit it to the village for its review and approval. The plan (including schedules) shall be consistent with applicable conditions of the village's SPDES permit, this chapter and state and federal laws.
D. 
The Sewer Administrator and responsible village personnel have the right to obtain wastewater samples as required to verify the reported discharge characteristics.
A. 
All industrial users who discharge or propose to discharge wastewaters to the wastewater treatment system shall maintain such records of production and related factors, effluent (discharge) flows and pollutant amounts or concentrations as are necessary to demonstrate compliance with the requirements of this chapter and any applicable State or Federal Pretreatment Standards or requirements.
B. 
Such records shall be made available upon request by the Sewer Administrator and/or village. All such records relating to compliance with pretreatment standards shall be made available to officials of the DEC or EPA.
C. 
The user of any premises or facility discharging industrial wastes into the public sewer system shall, when required by the Sewer Administrator or village, install at his own cost and expense suitable monitoring equipment to facilitate the accurate observation, sampling and measurement of the wastewater. Such equipment shall be maintained in proper working order and kept safe and accessible at all times. The sampling, analysis and flow measurement procedures, equipment and results shall be subject at any time to inspection by the Town or village representatives.
D. 
The monitoring equipment shall be located and maintained on the industrial user's premises outside of the building. When such a location would be impractical or cause any undue hardship on the user, the Sewer Administrator may allow such facility to be constructed within the building or in the public street or sidewalk area, with the approval of the public agency having jurisdiction over such street or sidewalk, and located so that it will not be obstructed by public utilities, landscaping or parked vehicles.
E. 
Whether constructed on public or private property, the monitoring facilities shall be constructed in accordance with the requirements of the Sewer Administrator and all applicable standards and specifications as required in this chapter.
A. 
Sampling requirements. In performing the measurements, tests and analyses on the characteristics of wastewater as required by this chapter, the sampling methods, locations, times, durations and frequencies are to be determined on an individual basis subject to approval by the Sewer Administrator and village.
B. 
Analysis of industrial wastewaters. Laboratory analysis of industrial wastewater samples shall be performed in accordance with the current edition of Standard Methods for the Analysis of Water Wastewater, published by the American Public Health Association, or the Annual Book of Standards, Part 23, Water, Atmospheric Analysis, published by the American Society for Testing and Materials. Analysis of those pollutants not covered by these publications shall be performed in accordance with procedures established by the DEC.
C. 
Testing laboratory. The measurements, tests and analyses required by this chapter shall be performed by a laboratory certified by the DEC.
A. 
All information and data on a user obtained from reports, questionnaires and monitoring programs from the inspections shall be available to the public or other governmental agency without restriction unless the user specifically requests on the questionnaire and is able to demonstrate to the satisfaction of the Sewer Administrator that the release of such information would divulge information, processes or methods which would be detrimental to the user's competitive position.
B. 
When requested by the user furnishing a report, the portions of a report which might disclose confidential information, trade secrets or secret processes shall not be made available for inspection by any person without providing the user with the opportunity to protect such information, including the right to seek judicial review; provided, however, that such portions of a report shall be available for use by the state or any state agency in any enforcement proceeding involving the user furnishing the report. Wastewater constituents and characteristics will not be recognized as confidential information.
