GENERAL REFERENCES
Subdivision of land — See Ch

No area or area shown and/or designated as a
street on a filed map or otherwise shall be accepted by the Common
Council as a public street until the owner or owners thereof have
provided and installed, at their sole cost and expense, all necessary
surface and sanitary sewer lines and all other surface and subsurface
improvements.
An area or street offered for dedication shall
have a minimum width of 50 feet or greater if the Common Council determines
that the conditions so warrant.

The minimum width for the paved section of a street shall be constructed in accordance with §
510-12N or greater if the Common Council and Planning Commission determine that the conditions so warrant.
Curbings shall be constructed on both sides
of the street for the entire distance sought to be dedicated.
Where streets intersect, they shall be connected
by a curve having a radius of not less than 25 feet.
Where cul-de-sac streets are approved for dedication,
a paved circle of not less than 80 feet in diameter from curb to curb
must be provided at the terminus. The diameter of the right-of-way
of such circle shall be 100 feet.
A complete system of surface drainage, including
catch basins, manholes and other necessary appurtenances, shall be
installed prior to the construction of the subgrade. Manholes are
to be spaced not more than 300 feet apart.
A complete system of sanitary drainage shall
be installed.
Street grades shall be not less than 1/2 of
1% and not more than 10%. The Common Council may, however, approve
grades not greater than 15% where in its opinion such grades would
not constitute a safety or traffic hazard. No grade in excess of 10%
will be permitted where a reasonable revision of plans would preclude
its necessity.
A complete water system shall be installed.
Block lengths shall not exceed 1,200 feet.
Monuments approved by the Common Council shall
be located on street lines and spaced within sight of each other.
The sight lines shall be contained wholly within the street limits
and shall not be more than 1,000 feet apart. They shall be arranged
and connected by means of coordinates so that the relation of any
point to any other point can readily be determined. This system shall
be referred to the Westchester County Coordinate System where possible.
Construction of streets, curbing, sidewalks,
sanitary and surface sewer systems, catch basins, paving, monuments
and all other surface and subsurface improvements must comply with
specifications prepared by the City Engineer and approved by the Common
Council.
Street signs approved by the Common Council
shall be installed on each street.
The Common Council may require that the owner
or owners shall construct a five-foot sidewalk on each side of the
street.
The following procedure shall be complied with
when an application is made for the dedication of a proposed street:
A. A written offer of dedication shall be filed with
the Common Council, together with proof of title of the land affected,
in a form acceptable to the Corporation Counsel.
B. Three copies of a site plan, scaled at not more than
100 feet to the inch and prepared by a licensed professional engineer
or licensed land surveyor, shall be filed with the Common Council.
The plan shall show the following:
(1) The property lines and the proposed street or streets
to be dedicated.
(2) The location and size of any existing and proposed
sewers, water mains, culverts and drainpipes.
(3) Contours, showing elevations based on Peekskill datum,
at intervals of not more than five feet.
(4) All parcels of land proposed to be dedicated.
(5) Date, North point and scale.
(6) License number and seal of the engineer or land surveyor
who prepared document.
C. Three copies of a plan prepared by a licensed professional
engineer shall be filed with the Common Council. The plan shall show
the following:
(1) The stationing and tie-in of the center-line distances
of streets with monuments and other points.
(2) Locations and widths of all streets, pavements, curbs,
sidewalk areas, easements; the proposed names of all streets; and
the radii of all curves in street lines and the location of all street
signs.
(3) The proposed water supply system.
(4) The proposed sanitary drainage system, plan and profile.
(5) The proposed stormwater drainage system, plan and
profile, with locations of catch basins and method of disposal of
collected stormwater.
(6) Any other proposed underground utilities.
(7) Typical cross sections of the roadway for the full
right-of-way width, showing character, width and depth of pavement
and subbase, location of utilities, character and dimensions of sidewalk
and curb, and side slope grading.
(8) Cross sections of intersections and other special
sections showing details of surface drainage.
(9) Designs for any culverts, retaining walls and other
special features.
(10)
Date, North point and scales of drawings.
(11)
Profiles showing original ground surface and
finished street surface at center lines of all streets, and percentage
of grades of proposed streets.

Upon the written recommendation of the Director
of Public Works, the plans aforementioned may be approved by the Common
Council.
Upon completion of all work incidental to the
construction of the proposed street, the owner shall deliver to the
Common Council all necessary deeds, in form acceptable to the Corporation
Counsel; proof of ownership of land offered for dedication, also in
form acceptable to the Corporation Counsel; and a bond of a recognized
surety company doing business in the State of New York, approved as
to form and sufficiency by the Common Council, the penal sum of which
bond shall be fixed by the Common Council, and the conditions or obligations
of which bond shall be that if the owner shall maintain and keep in
good repair the street, sewer system or other installations or other
component parts of the street as required by this chapter for a period
of one year from the date of the final acceptance of the street and
make payment to all claimants of their legal claims for all labor
and materials used in making the installations provided for in this
chapter, then the obligations or conditions thereof shall be satisfied
and the said bond shall be canceled and be null and void and the surety
released, otherwise to remain in full force and effect. Upon receipt
of the aforesaid documents and offer of dedication of the proposed
street, the Common Council may adopt a resolution of acceptance.

All work performed and materials used are to
be inspected and approved by the Director of Public Works or a person
designated by him. A minimum of six inspections shall be made, comprising
utility installation, the prepared subbase, a sample of the installed
curbs, the placed bottom course of the roadway, the completed binder
course and an inspection during the installation of the finish course.
The owner shall inform the Director of Public Works when the various
phases of the construction are ready for inspection. Upon completion,
a final inspection shall be made by the Director of Public Works.
The Director of Public Works and the Corporation Counsel jointly are
hereby authorized and empowered to promulgate, if they deem it necessary,
such rules and regulations as are reasonable and necessary to carry
out the provisions of this chapter.
