The purpose of this article is to regulate and establish a standard of conduct for the use of City sidewalks by abutting merchants who wish to extend beyond the confines of their premises for display purposes.

A merchant may utilize portions of the City sidewalk area located in front of his business for display purposes upon obtaining a permit from the City. Such permit shall be granted upon submitting the following documentation to the Director of Public Works or the Director’s designee:
A. 
Evidence of public liability insurance covering the sidewalk area in question naming the City of Peekskill as additional insured in a minimum amount of $1,000,000 per individual and $2,000,000 per occurrence.
B. 
Execution of a release to the City agreeing to defend, indemnify, and hold the City harmless from any and all liability in connection with any claims, actions, proceedings, and lawsuits brought in connection with the permittee’s use of the respective City sidewalk area.
The permittee shall arrange his displays so as to at no time occupy more than 1/2 of the width of the usable sidewalk area in front of his business. Said displays shall not impede the safe and orderly free flow of two-way pedestrian traffic on the respective sidewalk.

Permits as regulated by this article may be revoked by the Director of Public Works or the Director’s designee upon evidence that use of the sidewalk by the permittee violates the provisions of § 505-57 above.
Permits as regulated by this article shall automatically expire when the permittee no longer has in force the required amount of public liability insurance detailed in § 505-56A above.

A merchant violating any of the provisions of this article shall be subject to a warning for the first offense and a fine of not less than $50 nor more than $1,000 for each subsequent offense. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
