The proper officers of the borough are hereby authorized and directed to execute and to deliver a deed or instrument of conveyance of the water system to the Municipal Authority. Such deed or instrument of conveyance shall be in such form as shall be approved by the Borough Solicitor.
The proper borough officers are hereby authorized and directed to execute and to deliver to the Authority an assignment to the Authority of all existing contract rights, the existing cash surplus from water rent receipts less expenses for the period January 1, 1972, through April 30, 1972, accounts receivable and liabilities in connection with or arising out of the operation of the water system, especially including reimbursement to the borough for funds advanced to Albright and Friel for engineering costs concerning the additional water supply from Brandywine Creek. Such assignment shall be in such form as shall be approved by the Borough Solicitor.
The proper borough officers are hereby authorized and directed to execute and to deliver to the Authority an agreement, substantially in the form presented to this meeting, providing for the performance of certain administrative functions in connection with the operation of the water system by the borough and providing for the payments to be made by the Authority therefor.
The proper borough officers are hereby authorized and directed to execute an amendment to the borough group pension contract with Massachusetts Life Insurance Company, to provide that service with the Authority will be considered service with the borough, effective May 1, 1972, provided that the Authority shall fund the pension contract for its employees.
The effective date of all deeds, assignments and other instruments of conveyance shall be May 1, 1972, and thereafter all operational employees of the water system, especially including the borough's present Director of Public Works, shall become employees of the Authority.
