The owner and occupant of land shall be severally charged with the duty of keeping such land and the buildings thereon at all times clear of overgrown grass, weeds or brush, and any and all kinds of rubbish, waste or refuse which is or which may become flammable, combustible or likely to catch or spread fire; and should any of the persons so charged fail or refuse to comply with the provisions of this article or any part thereof, then said land and/or building shall become a public nuisance and shall be abated as provided in Chapter
237, Nuisances, Abatement of.

A. Any person committing an offense against any provision
of this article shall, upon conviction thereof, be guilty of a violation
pursuant to the Penal Law of the State of New York, punishable by
a fine not exceeding $250 or by imprisonment for a term not exceeding
15 days, or by both such fine and imprisonment. The continuation of
an offense against the provisions of this article shall constitute,
for each day the offense is continued, a separate and distinct offense
hereunder.
B. In addition or as an alternative to the above-provided
penalties, the Board of Trustees may also maintain an action or proceeding
in the name of the Village in a court of competent jurisdiction to
compel compliance with or to restrain by injunction the violation
of this article.

All premises throughout the Village, whether
or not covered by other provisions of the Code of the Village of Babylon,
shall be maintained in conformity with the following provisions of
this article so as to assure the desirable character of the property.
Surface and subsurface water shall be appropriately
drained to protect buildings and structures, to prevent the accumulation
of water on the ground or otherwise and to prevent flow upon property
of an adjoining owner, sidewalk or other public place. Gutters, culverts,
catch basins, drain outlets, stormwater sewers or other satisfactory
drainage systems shall be utilized where deemed necessary by the Building
Inspector.
Fences and other minor constructions shall be
maintained in good repair at all times.
Steps, walks, driveways, parking areas and other
paved areas shall be maintained so as to afford safe passage at all
times and shall be kept clean and free of debris, snow and ice.
Yards and courts shall be kept clean and free
of physical hazards and debris.
All lawns, common areas and recreation areas
shall be maintained in a clean and neat condition, and grass, weeds
or other vegetation shall be cut periodically to restrict growth in
excess of four inches.
Exterior surfaces of buildings and structures,
including fences, doors, window frames and porches that are not inherently
resistant to deterioration shall be maintained in a good state of
repair and periodically treated with a protective coating of paint
or other suitable preservative. Broken or missing clapboards, shingles
and window and door glasses shall be replaced.

Exterior lighting shall be constructed with shielding and/or
directional devices so as to limit direct illumination to the confines
of the property upon which the lighting is installed and so as not
to provide direct illumination to any surrounding property.

A. In all rental properties, required smoke alarms shall
receive their primary power from the building wiring and shall be
equipped with a battery back-up; wiring shall be permanent and without
a disconnecting switch other than as required for over-current protection.
B. In rental units and buildings only, floors, walls,
ceilings and fixtures shall be maintained in a clean and sanitary
condition.
Accessory structures shall be maintained so
as to be free of conditions detrimental to safety or health and shall
be kept in good repair. Painted surfaces shall be painted as required
to maintain the original finish.
Grounds, buildings and structures shall be maintained
free of insects, vermin, rodent harborage and infestation. Methods
used for exterminating insects, vermin and rodents shall conform to
generally accepted practice.
From May 1 to October 1, entrances to all residential
rental buildings and units shall be provided with self-closing-type
devices or screens, and windows and other openings used for ventilation
shall be appropriately screened.
Adequate sanitary facilities and methods shall
be used for the collection, storage, handling and disposal of garbage
and refuse.
In multiple dwellings it shall be prohibited
to store or accumulate garbage or refuse in public halls and stairways.

A. The owner, agent, or occupant of any business premises within the Incorporated Village of Babylon shall be responsible for the sanitary condition of premises owned or occupied by said owner, agent or occupant. It shall be unlawful for anyone to place, deposit or store, or cause to be placed, any refuse on his premises except in accordance with the provisions of this Chapter

B. The owner, agent or occupant within the Incorporated
Village of Babylon shall be responsible for the cleanliness of the
sidewalk in front of and/or adjoining his premises.
