There is hereby established a Parks and Recreation Commission for the Town of Union, Broome County, New York.
As used in this article, the following terms shall have the meanings indicated:
PARKS OR PARK
All dedicated public parks, playgrounds, athletic fields, recreation centers, open spaces and other areas used for park and recreation purposes and beautification projects, including all buildings, structures, equipment and appurtenances, as well as entrances and approaches thereto, and roads and parking places located in such park or parks, and such other rights and appurtenances as the Town may have or utilize for such park purposes, whether the same are under the care and control of the Town by lease or otherwise, provided only that the same are used for park and recreation purposes or either of such purposes.
RECREATION
Leisure activities voluntarily engaged in which are offered under the auspices of the Town of Union Parks and Recreation Commission.

The Commission shall consist of five members who reside in the part-Town area of the Town of Union. Appointment shall be by the Town Board of the Town of Union. The first member appointed shall serve for a term of one year, the second member shall serve for a term of two years, the third member shall serve for a term of three years, the fourth member shall serve for a term of four years, and the fifth member shall serve for a term of five years. Thereafter, the term of office of each member shall be for five years. Vacancies on the Commission shall be filled in the same manner as the original appointment, except that a vacancy occurring other than by the expiration of term of office shall be filled only for the remainder of the unexpired term.
The members of the Parks and Recreation Commission shall serve without compensation but shall be entitled to reimbursement for any expenditures authorized in the performance of their duties.
The Commission shall annually elect, from its own members, a Chairman and Vice Chairman.[1]

A. 
The Commission shall advise the Town Board and Deputy Commissioner of Public Works for Parks and/or Recreation on policies which govern the regulation and use of Town parks and recreation programs.
B. 
The Commission shall ascertain and evaluate the recreation needs of all Town residents and recommend to the Deputy Commissioner of Public Works for Parks and/or Recreation from time to time the establishment, operation and expansion or retrenchment of parks and recreation services with respect to these needs.
C. 
The Commission shall develop and recommend to the Town Board plans for future park and recreation programs and facilities, capital projects and improvements.
D. 
The Commission shall advise the Town Board and the Deputy Commissioner of Public Works for Parks and/or Recreation on the operating budget and capital project improvements or expansions.
E. 
The Commission shall recommend long-range plans to the Town Board, and also recommend operating policies and regulations to the Deputy Commissioner of Public Works for Parks and/or Recreation, for the protection, conservation and enhancement of the natural plant life, wildlife, brooks, ponds and other water resources, soils and scenic beauty of Town park lands.
F. 
The Commission shall advise on matters having to do with the regulation and use of the parks and recreation facilities and submit to the Town Board, for its consideration, resolutions or ordinances regulating the use of such facilities and fixing the fees and charges to be paid for the use of any such facilities.
G. 
The Commission may appoint such committees from time to time as it may deem necessary.

The Commission shall regularly meet once each month at a time and place set by said Commission for its regular meeting, and such meeting shall be open to the public. A quorum shall consist of three members. The Chairman or any two members of the Commission may call a special meeting of said Commission for such purposes as are designated in said call. Notice of said meeting shall be given in writing to all members and to the Deputy Commissioner of Public Works for Parks and/or Recreation 72 hours in advance of said special meeting. The Town Clerk shall be responsible for giving notice of all regular and special meetings of the Parks and Recreation Commission.
