No person shall uncover, make any connection
with or opening into or use, alter or disturb any public sewer or
appurtenance thereof without first obtaining a written permit, in
accordance with the regulations as established by the Town.
There shall be two classes of building sewer
permits: Class 1 for residential and Class 2 for establishments producing
commercial or industrial wastes. In either class, the owner or his
agent shall make application for such a connection on a form therefor
furnished by the Town. The permit application shall be supplemented
by any plans, specifications or other information considered pertinent
in the judgment of the Commissioner of Public Works. Permits expire
30 days from date of issue.
All costs and expenses incidental to the installation
and connection of the building sewer shall be borne by the owner of
the property being served. The owner shall indemnify the Town for
any loss or damage that may directly be occasioned by installation
of the building sewer by filing a bond of $5,000 with the Town Board.
Bonds shall contain a clause stating that permits granted may be revoked
at any time.
A separate independent building sewer shall
be provided for every building, except where one building stands at
the rear of another on an interior lot and no sewer is available or
can be constructed to the rear building through an adjoining alley,
courtyard or driveway. Under such conditions, the building sewer from
the front building may be extended to the rear building and the whole
considered as one building sewer. Building sewers shall not be connected
through a cesspool or septic tank. In addition, industrial users shall
provide separate connections for process water discharges and domestic
wastes to the public sewer system.
Old building sewers may be used in connection
with new buildings only when they are found, on examination, and tested
by the Plumbing Inspector to meet all requirements of this chapter.
The building sewers shall be constructed in
accordance with the applicable portions of the Plumbing Code, as amended.
Building sewers shall be serviced and maintained
by the Town. However, if a defect is discovered which necessitates
repair or replacement of the building sewer between the property line
of any public right-of-way and the building drain, the Commissioner
of Public Works shall notify the property owner of the necessary correction.
Subsequent to such notice and prior to the approved correction, the
Town will perform no service to or maintenance of the building sewer,
except for emergencies, as determined by the Commissioner of Public
Works.
