A. The owner or tenant of any lands fronting on any street,
highway, road or roadway shall be required to keep all bushes, hedges and
other plant life growing within 10 feet of any street cut or trimmed to a
height of not more than 2 1/2 feet where it shall be determined by the
Division of Inspections that such cutting or trimming shall be necessary and
expedient for the preservation of the public safety and particularly to eliminate
obstructions to visibility for pedestrians and vehicular traffic using such
street, road, roadways or highway.
B. Any owner of lanes fronting on the intersection of two
streets, highways, roads or roadways shall be required to keep all bushes,
hedges and other plant life growing within 10 feet of any street and within
25 feet of such intersection trimmed to a height of not more than 2 1/2
feet where it shall be determined by the Division of Inspections that such
cutting or trimming shall be necessary and expedient for the preservation
of the public safety and particularly to eliminate obstructions to visibility
for pedestrians and vehicular traffic utilizing such street, road, roadway
or highway.
C. Any person violating this section shall be given a written
notice that such bushes, hedges or other plant life shall be cut or trimmed
within 10 days of the receipt of said notice.

In the event that such owner or tenant fails, neglects or refuses to
cut or trim such bushes, hedges and other plant life within the time period
authorized by this article, then and in that event the Department of Public
Works of the Township of Brick is hereby authorized, empowered and directed
to trim and cut or cause to be trimmed and cut such bushes, hedges and other
plant life to a height of not more than 2 1/2 feet. The Department of
Public Works immediately thereafter shall certify the cost thereof to the
Township Council, which, if the cost is reasonable and correct, shall charge
the same against such lands. The amount so charged shall forthwith become
a lien upon such lands and shall be added to and become and form part of the
taxes next to be assessed and levied upon such lands, the same to bear interest
at the same rate as other taxes, and shall be collected and enforced by the
Tax Collector in the same manner as taxes.

Any person, firm or corporation who violates any provision of this article shall, upon conviction, be punished as provided in Chapter
1, §
1-15, General penalty, in the discretion of the court before which such conviction may be had.
