Any owner of a one-family residential dwelling located within the Township of Brick who, individually or through a condominium association or cooperative housing corporation of which he is a member or shareholder and which is either occupant- and/or tenant-controlled, contracts with a private scavenger for garbage and refuse collection service for the dwelling because of the unavailability of said service by employees of the Township of Brick may request, through his condominium association or cooperative housing corporation in which he is a member, or by an individual request if collections are individually contracted for, to the Township Clerk's office that the Township reimburse the private scavenger garbage and refuse collection costs for said dwelling pursuant to § 390-18E herein.
A. 
The request for reimbursement shall be in writing on the form provided for said purpose and available in the Township Clerk's office.
B. 
Upon receipt of said request, copies of the same shall be forwarded by the Township Clerk's office to the Business Administrator, Treasurer and Superintendent of Public Works for a review of the same and a determination if there are any objections to granting said request from an administrative or financial viewpoint Additionally, the report from, the Treasurer and Superintendent of Public Works shall provide an estimate of the cost that the Township would incur if its employees provided curbside garbage and refuse collection to the dwelling in the same manner and frequency as if said dwellings were located on streets dedicated to the public.
C. 
The reports referred to in Subsection B herein shall be issued within 30 days of receipt by the Township of the request referred to in Subsection A herein.
D. 
After receipt of the various reports referred to in Subsection B herein, the Township Council may, by resolution, grant or deny the request or requests, setting forth reasons for the decision, except that no such owner shall be reimbursed for any number of refuse collections per week in excess of the number of refuse collections per week provided by the Township to residential dwellings generally throughout the Township.
E. 
If the request for reimbursement is granted, the Township, by resolution, shall authorize reimbursement of private scavenger garbage and refuse collection costs in an amount equal to the actual cost or equal to the estimate of the cost to the Township if said service were performed by Township employees, whichever amount is lower.
Any individual, condominium association, corporation, group or other entity who has requested reimbursement pursuant to the terms of this article shall have the right to withdraw from said program or reimbursement by notifying the Township Council, in writing, through the Township Clerk of its request to withdraw from the program. Upon receipt of said request by the Township Clerk, the withdrawal from said program shall be automatically granted without any formal action by the Township Council, and a copy of said request shall be forwarded to the Treasurer's office for information purposes.
