A. 
There is hereby established in the Borough of Clementon a State Uniform Construction Code enforcing agency, to be known as the "Clementon Construction Code Agency," consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Fire Subcode Official and Electrical Subcode Official and such other subcode officials for such additional subcodes as the Construction Commission of the Department of Community Affairs, State of New Jersey shall hereinafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.

B. 
Each official position created in Subsection A hereof shall be filed by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended,[1] and N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold such position.

The public shall have the right to do business with the enforcing agency at the Borough Hall.
The Clementon Mayor and Borough Council establishes the Camden County Board of Appeals to hear all appeals from decisions of the enforcing agency.

A. 
The fee for a construction permit shall be the sum of the subcode fees listed below and shall be paid before the permit is issued.
(1) 
The building subcode fee shall be:

For new residential construction: $0.040 per cubic foot of building or structure volume.
(b) 
For new commercial construction: $0.030 for Use Groups A-4, F-1, F-2, S-1, and S-2; all other commercial construction: $0.040 per cubic foot of building or structure.
(c) 
For renovations, alterations, minor construction and repairs:

Estimated cost up to and including $50,000: $35 per thousand or fraction thereof.

Estimated cost of $50,001 up to and including $100,000: $32 per thousand or fraction thereof.

This fee shall be waived when signed statements and supportive inspection and acceptance test reports are filed by an approved qualified agent or agency in accordance with N.J.A.C. 5:23-2.19 and 5:23-2.20.

The fee for performing inspections of minor work shall be $75.

The fee for plan review for elevator devices in structures in Use Groups R-3 and R-4, and for elevator devices wholly within dwelling units in R-2 structures, shall be $75 for each device.

The fee for plan review for elevator devices in structures in use groups other than R-3 and R-4, and otherwise exempt devices in R-2 structures, shall be $260 for each device.
B. 
The fees for certificates of occupancy shall be as follows:
(1) 
Other-than-residential fee shall be $120.
(2) 
One- and two-family residences less than 5,000 square feet in area and less than 30 feet in height shall be $75.

The fee for a certificate of occupancy granted to change the use shall be $174.
(4) 
The fee for a certificate of occupancy for residential shall be $75.

The fee for all other use groups shall be $120.
(6) 
The fee for a certificate of continued occupancy: $151.

C. 
The Department of Community Affairs training fees shall be as follows:
(1) 
As required by the Uniform Construction Code Act,[3] a surcharge of $0.0034 per cubic foot of volume of the new construction.

A surcharge of $0.00190 for permits, other than new construction, based on the estimated cost of the work over $625.

The surcharge is to be remitted to the Bureau of Housing Inspection, Department of Community Affairs, on a quarterly basis.
D. 
Asbestos abatement; fees:
(1) 
The administrative fee for each construction permit for asbestos abatement shall be $125.

(2) 
The administrative fee for each certificate of occupancy after the successful completion of an asbestos hazard abatement project shall be $35.

(3) 
The authorization and reauthorization fees for the asbestos safety control monitor shall be as set forth in N.J.A.C. 5:23-8.18.
(4) 
The application fee for certification as an asbestos safety technician shall be as set forth in N.J.A.C. 5:3-8.19.
E. 
Lead abatement fees:

(1) 
The administrative fee for lead hazard abatement work shall be $176.
(2) 
The fee for a lead abatement clearance certificate shall be $50.

F. 
Plan review fee. The plan review fee shall be 40% of each listed fee. Where the Construction Department performs plan review only, the plan review fee shall be in the amount of 25% of the new construction permit fee.
G. 
Application for a variation fee. In accordance with N.J.A.C. 5:23-2.10, an application for a variation fee shall be $748 for Class I structures and $151 for Class II and Class III structures. The fee for resubmission of an application for a variation shall be $289 for Class I structures and $82 for Class II and Class III structures.
