[Adopted as Sec. 3-14 of the Revised General Ordinances]
As used in this article, the following terms shall have the meaning indicated:
CONSUMPTION OF ALCOHOLIC BEVERAGES
Drinking or possession in open containers or possession in nonoriginal containers of any alcoholic beverages as defined by the Revised Statutes of the State of New Jersey.
The consumption of alcoholic beverages, except as contained in § 77-12 hereof, is prohibited in public parks, playgrounds, recreation facilities, school grounds and facilities, places of public use and convenience, such as train and bus depots, lavatories, rest rooms, vacant or unimproved Borough lands and in parking lots owned or controlled by the Borough through permission granted by the owner.

No person shall dispense, consume, drink or imbibe or sell any alcoholic beverages as defined by the Revised Statutes of the State of New Jersey upon:
A. 
Any public street, road, alley, avenue, sidewalk, public parking place, recreation area or any other public or quasi-public place.
B. 
A public conveyance.
C. 
A private motor vehicle while the same is in motion or parked in any public street, land, public road, public parking place or quasi-public place.
D. 
Any private property not his or her own, without the express permission of the owner or other person having authority to grant such permission.
E. 
Any public facility, including but not limited to any eating or catering establishments, unless such establishment is duly licensed by the State of New Jersey for the service of alcoholic beverages.
Notwithstanding any provisions contained herein to the contrary, block party permits or resolutions authorizing block parties shall include the right to possess or consume alcoholic beverages on a public street and shall not be deemed violative of this section.
It shall be unlawful for any person to sell, distribute, transfer, give or by any other means supply any beer, wine or alcoholic beverage to any person under the legal age to purchase alcoholic beverages in any public or quasi-public place or while in or on a public street or thoroughfare or while in a parked vehicle on any street or public thoroughfare in the Borough, except transfers between a parent and his or her minor child.
Any person who violates any provision contained in this section, shall, upon conviction thereof in the Municipal Court in the Borough, be subject to a fine as stated in Chapter 1, General Provisions, Article II.
