Within the Parks and Public Purposes Zone (PPP), no premises, lot, building or structure shall be used, and no building or structure shall be erected or altered to be used in whole or in part for any other than the following specified uses.

Public library, public park, public museum, Borough municipal building(s), public school(s), day care, nursery schools, community centers, meeting halls, municipally operated swimming club facilities and privately operated swimming club facilities, provided that same are operated by a nonprofit, publicly owned, private membership swimming club, the majority membership therein being limited to residents of the Borough and; provided, further, that not more than 40 family memberships are permitted to nonresidents of the Borough and; provided, further, that the officers and trustees of the private swim club are limited to residents of the Borough.

Any privately owned parcel in the Parks and Public Purposes Zone (PPP) may only be developed with a single-family residential use, and such lot shall be required to adhere to the bulk and zoning standards consistent with the parcel's size; provided, however, that if such parcel is contiguous to a lot within another residential zone, the bulk standards applicable to such residential zone shall apply.
A. 
Application for a building permit for the construction of any privately operated swimming club facility as defined by this article shall be made directly to the Construction Official of the Borough, on such forms as shall be supplied by the Borough Clerk for this purpose, which application shall be accompanied by 10 copies of a plot plan, drawn to a scale of not less than one inch equals 100 feet, prepared by a licensed civil engineer and surveyor of the State of New Jersey, which plot plan shall set forth the proposed location of all facilities, including but not limited to structures, pools, bathhouses and other appurtenances thereto pertaining, which the applicant proposes to erect or install upon the premises shown on the aforesaid plot plan. The plot plan shall also disclose the location of all parking facilities, fences, screening, landscaping, sanitary facilities, lighting facilities, showing the manner in which these facilities shall be constructed and located on the lot. A copy of the building specifications shall be attached to the plot plan.
B. 
The applicant shall also, simultaneously, with the filing of the aforesaid plot plan and specifications with the Construction Official, forward a copy thereof to the Borough Engineer and to the Board of Health of the Borough. The Board of Health shall examine same to ascertain whether there has been compliance with the applicable sanitary codes of the Borough. The Borough Engineer shall examine same to ascertain whether the drainage facilities and other such improvements are in compliance with Borough requirements. The Board of Health and the Borough Engineer shall thereafter submit a written report on the proposed application to the Construction Official within 30 days from the date of the request thereof.
C. 
Following the receipt of all the reports mentioned above, the Construction Official shall make specific findings of fact and report same to the Borough Council.
D. 
The Mayor and Council, upon receipt of the report of the Construction Official, and if all the requirements have been met, shall, by resolution, approve the application. If approval shall be granted and all other municipal requirements are complied with, the Mayor and Council shall instruct the Construction Official to issue a permit for such structures or use, subject to the requirements of this section.
In determining whether the application shall be granted, the Mayor and Council shall consider those factors with regard to the proposed use which could or may affect the health, welfare and safety of the community and due consideration to the orderly development of the community so as to provide adequate provisions for circulation of traffic and services.
A. 
Private swimming club facilities shall be located on a lot having an area of not less than six acres.
B. 
There shall be no facilities for the sale or dispensing of alcoholic or intoxicating liquor or beverages and none shall be dispensed or sold.
C. 
There shall be a minimum of one off-street parking space for each member family.
D. 
The maximum land coverage by all structures, including swimming pool(s), shall be 20% of the total area of the lot.
E. 
Where the property in question directly abuts a residential zone, all structures shall be set back a minimum of 100 feet from any neighboring property line, and parking areas shall be set back a minimum of 50 feet from any neighboring property line.
F. 
Where the property in question does not directly abut a residential zone, all structures shall be set back a minimum of 50 feet from any neighboring property line and parking areas shall be set back a minimum of 10 feet from any neighboring property line.
G. 
There shall be appropriate ingress and egress to the property and to parking facilities located thereon for both pedestrian and motor vehicle traffic.
H. 
The lot shall be appropriately landscaped and there shall be appropriate screening by the use of landscaping and fencing, so that the structures and pool(s) on the lot shall not be visible from any public street.
I. 
There shall be appropriate lighting provided for the safe operation and use of parking area and pedestrian walks.
J. 
Although public-address systems may be employed, their use must be such that they are not audible from a position off the lot in question, and the hours of operation of public address systems shall be limited to the hours of 10:00 am. to 8:00 p.m.
K. 
The facilities on the lot may be used only between the dates of May 30 to and including September 30 in each year, except upon special permission of the Mayor and Council following appropriate application when special permission may be granted for a one-day permission.
L. 
The sale or dispensing of food shall not be permitted, except upon special permission granted by the Mayor and Council of the Borough, upon application, for one day.
M. 
The hours of operation of the swimming club shall be limited to the hours of 10:00 am. to 1/2 hour after sunset.
N. 
The number of persons permitted on the premises at any one time shall not be greater than one person for each 150 square feet of property covered by the application, except that special permission to exceed this limit may be granted by issuance of a one day permit, upon application to the Mayor and Council of the Borough.
O. 
The applicant shall comply with all ordinances of the Borough, including but not limited to the Building Code,[1] and those dealing with health and sanitary matters and shall comply, in addition thereto, with the provisions of any ordinance regulating the use, construction or operation of swimming pools within the Borough.

The operator of any private swimming club, as defined by this article, shall be required to pay the same fees for the procurement of a building permit as is provided in the appropriate ordinance of the Borough and shall, in addition thereto, pay to the Board of Health of the Borough, an annual inspection fee of $100, which shall be used by the Board of Health for the purpose of defraying the cost of inspecting the premises by the Board of Health or the Borough Health Officer and/or the Construction Official of the Borough.
In the event the use of the property as applied for hereunder is abandoned, the applicant and/or owner of the premises shall, within six months thereafter, cause all structures and facilities to be removed from the premises and shall cause any tank-type pool or other excavations in the ground to be filled with clean earth so that the premises will, as nearly as possible, be restored to its original condition as vacant land. Failure to operate the bathing facilities for a period of one year shall constitute abandonment within the meaning of this section, unless the failure results from action or permission of any lawful governmental authority.
