Remedial fee. Notwithstanding any other provision
of this section, where any applicant for a building permit, or certificate
of occupancy or completion, is made for approval or authorization
of or for any work or activity which has already been commenced or
completed, and for which an approval was required to be obtained prior
to commencement or completion, the fee required for such application
shall be three times the fee which would have been required had the
permit or approval been obtained on a timely basis. Upon a showing
of exigent circumstances which justify the failure to make timely
application for, or timely obtain, such permit or approval, the Board
of Trustees, in its sole discretion, may waive the additional fee
required by this paragraph in whole or in part.
