[HISTORY: Adopted by the Borough Council of the Borough of Dravosburg 6-19-1984 by Ord. No. 84-10. Amendments noted where applicable.]
For purposes of this chapter, terms and words are defined as follows:
INTENT TO CONSUME
Includes any of the following:[1]
A. 
Drinking from the container.
B. 
Possession with movement of the container to the mouth.
C. 
Possession with alcohol on the breath of the possessor.
D. 
Any circumstances evidencing an intent to ultimately consume on any public lands without permission.
INTOXICATING BEVERAGES
All beverages deemed to be intoxicating or alcoholic under the Liquor Laws of the Commonwealth of Pennsylvania or the rules and regulations of the Liquor Control Board of the Commonwealth of Pennsylvania.
POSSESSION
Exercise of dominion over the container or beverage.[2]
PUBLIC HIGHWAYS
All public highways of the Borough of Dravosburg, either opened or unopened.
PUBLIC SIDEWALKS
All public sidewalks of the Borough of Dravosburg.
PUBLIC STREETS
All public streets of the Borough of Dravosburg, either opened or unopened.
SUSPEND (SUSPENSION)
To prohibit and to render illegal.
TRANSPORTATION
Any movement of intoxicating beverages from one location to another, unless such intoxicating beverages are packaged in paper, cardboard, or other proper packaging, and remain unopened.

It shall be unlawful at any time for any person to possess with intent to consume, consume, display, transport, or drink intoxicating beverages in or from open containers on the public streets, public highways, or public sidewalks of the Borough of Dravosburg, or to engage in same from any vehicle situate on the public streets or public highways of the Borough of Dravosburg.

This chapter shall not apply to possession with intent to consume, consumption, display, transportation, or drinking of intoxicating beverages in those areas or establishments specifically licensed by the Liquor Control Board of the Commonwealth of Pennsylvania for the possession with intent to consume, consumption, display, transportation, or drinking of intoxicating beverages.

Any person violating the provisions of this chapter shall, upon summary conviction, be subject to a fine of not more than $600, plus costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for a term not to exceed 30 days.
