The contract, dated November 10, 1970, between Delmarva Power & Light Company of Maryland on the one part and St. Michaels Utilities Commission and The Commissioners of St. Michaels on the other part, for the furnishing of electric energy by Delmarva Power & Light Company of Maryland to St. Michaels Utilities Commission, be and the same is hereby approved.
The President and Secretary of The Commissioners of St. Michaels be and they are hereby authorized, in behalf of The Commissioners of St. Michaels, to execute the aforesaid contract and to affix the Seal of said Town thereto.
Delmarva Power & Light Company of Maryland, its successors and assigns, be, and it hereby is, authorized and empowered in perpetuity to erect, construct, reconstruct and maintain electric poles, lines, conductors and/or appurtenances under, along, upon, over or across the streets, squares, lanes, alleys and other public property in the Town of St. Michaels along or adjacent to the route of its existing transmission line from Easton to St. Michaels and from St. Michaels to McDaniel, which line extends through the Town of St. Michaels in a generally northwesterly direction from the southerly to the northerly corporate limits of the Town, closely paralleling the right-of-way of Penn Central Railroad through such Town and lying adjacent thereto on its northeasterly side at varying distances therefrom; provided, however, that nothing herein contained shall, directly or indirectly, authorize or empower the said Delmarva Power & Light Company of Maryland, its successors and assigns, to distribute or sell electric energy to consumers within the service area of the St. Michaels electric system as delineated on U.S. Geological Survey maps of Oxford, Claiborne, St. Michaels, Trappe and Easton, all within the State of Maryland, on file in the offices of the Public Service Commission of Maryland, as prescribed by said Commission in its Order No. 56203 in Case No. 6017 (1966), Reports of the Public Service Commission of Maryland, Vol. 57, page 59, (except pursuant to authorization heretofore or hereafter granted by the Public Service Commission of Maryland), unless the consent of Utilities Commission and/or the Town thereto be first obtained.
This ordinance shall take effect from the date of its passage.[1]
