Whoever, being then under the age of 21 years, shall have upon or about his person or shall have in his possession any alcoholic, malt or spiritous beverage within the limits of the Town of Middletown, or within the limits of the public lands vested in said Town, shall be guilty of a misdemeanor and shall be fined, for the first offense, not less than $50 nor more than $100, and for each subsequent like offense shall be fined not less than $75 nor more than $200.

Whoever, being then under the age of 21 years, shall consume any alcoholic, malt or spiritous beverage upon the streets, byways or any other public place within the limits of the Town of Middletown, or within the limits of the public lands vested in said Town, shall be guilty of a misdemeanor and shall be fined, for the first offense, not less than $50 nor more than $100, and for each subsequent like offense shall be fined not less than $75 nor more than $200.
The provisions of this article shall not apply either to the possession or consumption of alcoholic or spiritous beverages when consumed as an integral part of the sacramental rites performed in the course of religious services conducted in a church building or other house, or where such consumption is for medicinal purposes pursuant to the direction or prescription of a physician or surgeon duly licensed to practice within this state.

No individual shall possess any open containers of alcoholic liquor in any vehicle or on any public street, avenue, alley or sidewalk within the corporate limits of the Town.
No individual shall consume or possess any open containers of alcoholic liquor on public or private property if this conduct is prohibited by the owner, lessor or lessee or their authorized agents of said public or private property.

Any individual found guilty of violating the provisions of this article shall be fined not more than $100.
