It shall not be lawful for any railroad company to suffer or permit any safety gates at any place where their tracks cross any public street in the Town of Middletown, Delaware, to remain down across said street or streets except when a locomotive, train, car or other vehicle is approaching on or standing on said tracks; and if it shall suffer or permit said gates so to remain down, said company and the person having charge of said gates shall, upon conviction thereof, forfeit and pay a fine as provided in § 123-3.

It shall be unlawful for any railroad company to suffer or permit any locomotive, train, car or other vehicle belonging to or in the use of said company to remain stationary upon the tracks owned or used by said railroad company where the same cross any of the public streets of said Town of Middletown for a longer period than five minutes; and if it shall suffer or permit said locomotive, train, car or other vehicle so to remain stationary for a longer period than five minutes, unless in case of accident, said company and the person having charge of said locomotive, train, car or other vehicle shall, upon conviction thereof, forfeit and pay a fine as provided in § 123-3.

Violations of this chapter shall be punishable by a fine of $50.
