A. 
Word usage. Whenever used in this chapter, words used in the singular include the plural and vice versa.
B. 
Definitions. As used in this chapter, the following terms shall have the meanings indicated:
DEPARTMENT
The Town of Huntington Department of Audit and Control, and it shall perform a major function of town government.
DEPUTY DIRECTOR
The Deputy Director of the Town of Huntington Department of Audit and Control, who in the absence of the Director shall act generally for and in the place of the Director.
DIRECTOR
The Director of the Department of Audit and Control, and he shall be the chief executive officer of the Department.

A. 
There is hereby established, as a separate Department in the town government of the Town of Huntington, the Department of Audit and Control. The principal executive officer and administrative head of such Department shall be the Director of Audit and Control, who shall be appointed by the Town Board for a term of office fixed by law, at such salary as may from time to time be fixed by the said Town Board. The Director shall be appointed on the basis of his administrative experience and qualifications for the duties of such office and shall meet any additional standards as may be required by the Town Board. The Director shall be the head of the Department, with power and authority to appoint and remove officers and employees under his jurisdiction in accordance with the Civil Service Law and other applicable laws, except the appointment and removal of the Deputy Director, who shall be appointed and removed by the Town Board.
B. 
The Deputy Director shall generally act for and in behalf of the Director and shall perform such duties vested in and imposed upon that official by the provisions of this chapter, by statute or by other lawful authority.

The Director shall have such powers as shall be necessary for the proper administration of the Department consistent with applicable provisions of law. The Department shall be divided into the following Divisions:
A. 
Comptroller.
B. 
Purchasing.
C. 
Payroll.
The powers and duties of such Division therein shall be under the administration, direction and control of the Director, and each of the Divisions shall be supervised by a Division head who shall be designated as Division Administrator. The powers and duties of individual Divisions shall be:
A. 
Division of Comptroller. This Division shall perform the following functions:
(1) 
To administer, manage, assemble and maintain all financial records, books and documents necessary to reflect and record all transactions of the Town of Huntington affecting its assets and financial interests and to periodically prepare financial reports and submit same to state, county and town agencies.
(2) 
To administer, manage, prepare and maintain accounts, records and documents of all disbursements of the Town of Huntington and, upon proper approval, to make payment of all claims and indebtedness of the Town of Huntington.
(3) 
To administer, manage, prepare and maintain accounts, records and documents of all receipts, accounts receivable, investments and borrowings of the Town of Huntington.
(4) 
To administer, manage, supervise and implement all necessary and related procedures for the auditing and verification of all charges, claims, demands and accounts against the town and to audit operations, accounts and fiscal affairs of every department of the town pursuant to prevailing law, rules and regulations and to audit all income financial transactions of the town to assure sufficiency and accuracy of same.
(5) 
When so appointed by the Supervisor, to administer, manage, prepare and supervise procedures and programs for evaluation of departmental estimates of operating budgets of all departments and to prepare and submit a tentative budget to the Town Board, to administer all budget funds and appropriation accounts and to prepare and coordinate projected budgetary forecasts for operating and capital improvements needs.
(6)

B. 
Division of Purchasing. This Division shall perform the following functions:

(1) 
To administer the town's purchasing policy and procedures, including the preparation or review of specifications and all bidding procedures for supplies, equipment, services and public works contracts.
(2) 
To administer purchasing contracts and to process all vendor billing.
(3) 
To maintain inventory of all materials and supplies.
(4) 
Local Preference: The Director of the Purchasing Division of the Department of Audit and Control, or a Committee, if one shall have been appointed by the Town Board, that evaluates, reviews and recommends to the Town Board the proposal which it believes should be accepted from among the proposals received pursuant to the Town's request for proposals under General Municipal Law § 104-b, shall include but not be limited to the following criteria: financial capability, training and experience in the field, references and prior work, quality of staffing and ability to complete the project or provide the service, responsibility of proposer and cost. In considering cost, any person or other entity which has maintained a place of business, staffing and an operational office at an address located within the Town of Huntington for at least one year prior to the date of making a proposal, may, in the discretion of the evaluator, be considered to have proposed the lowest price, if that price is not more than 5% over the price quoted by a business not maintaining an office within the Town of Huntington.

(5) 
The Director of the Purchasing Division shall be authorized to use Best Value Award Methodology for purchase contracts, for service work including contracts, but excluding contracts necessary for the completion of a public works contract pursuant to Article 8 of the New York Labor Law. The Best Value Award Methodology shall include the ability to purchase from cooperatives.

C. 
[2]Division of Payroll. This Division shall perform the following function: to administer, manage, prepare and supervise procedures for the efficient payment of wages to town employees.[3]

Nothing herein contained shall be construed to delegate or transfer any power of the Town Supervisor contained in §§ 29, 52 and 125 of the Town Law of the State of New York or any other powers which may be lawfully exercised by said Supervisor. Nothing herein contained shall be construed to delegate or transfer any powers conferred or which may be lawfully exercised by the Comptroller pursuant to the Town Law of the State of New York.
If any section, provision or part thereof in this chapter shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, then such adjudication shall not affect the validity of the chapter as a whole or any section, provision or part thereof not so adjudged invalid or unconstitutional.
This chapter shall be effective when the appropriate certified copies are filed with the Secretary of State of the State of New York.
