As used in this Chapter, the following words
shall have the meanings indicated:
ALLEY
A public space or thoroughfare twenty (20) feet or less in
width and which has been deeded or dedicated for public use.
ALTERATION
A change or rearrangement within a building affecting structural
strength or involving plumbing changes which include a new connection
larger than a two-inch pipe to the drainage system; or changes involving
exit facilities of a building: an enlargement either in height or
width; or moving a building from one location to another. The verb
"alter" in any of its parts refers to the making of an "alteration."
(See "repair.")
AMUSEMENT DEVICE
A mechanically operated apparatus used to convey persons
in any direction as a form of recreation.

BEARING WALL
A wall which supports any vertical load in addition to its
own weight.
BUILDING
A combination of materials to form a construction that is
safe and stable and which is adapted to continuous occupancy on a
permanent basis for residence, business, storage, institutional or
public purposes. The word "building" is used synonymously in this
chapter with the word "structure." Both words shall be construed as
if followed by the words "or parts thereof."
BUILDING LINE
The line, established by law, beyond which a building shall
not extend, except as specifically provided by law.
BULKHEAD
As applied to building construction, means a structure above
the roof of any part of a building enclosing a stairway, tank, elevator
machinery or ventilating apparatus, or such part of such shaft as
extends above the roof. As applied to waterfront construction, means
a construction of piling or masonry used to prevent damaging action
by any body of water upon the adjacent land.
CINDER CONCRETE BLOCK
A block made of portland cement and coarse aggregate of clean,
good quality cinders resulting from the combustion of coal.
COMBUSTION SAFETY TESTING STANDARDS AND PROCEDURES
Testing required for every New York State ENERGY STAR Labeled
Home conducted according to Building Performance Institute procedures
that includes carbon monoxide testing, draft measurement, spillage
evaluation and worst-case depressurization of all combustion appliance
zones. In homes with natural gas/propane service, the gas line is
thoroughly inspected for leaks.

CONCRETE
A mixture of cement, sand and coarse aggregate.
CONCRETE BLOCK
A block made of portland cement and natural aggregate such
as sand, pebbles and/or gravel.
CONVERTED DWELLING
A dwelling heretofore erected to be used or occupied by one
(1) family unit or by two (2) family units living independently of
each other and heretofore or hereafter used or occupied as a multiple
dwelling.
DEAD LOAD
The weight of walls, partitions, framing, floors, roofs and
all other permanent construction of a building.
DWELLING
Any building or portion thereof which is occupied in whole
or in part as a home, residence or sleeping place of one (1) or more
family units.
ELEVATOR
An apparatus within or in connection with a building, used
for carrying persons or things upward or downward. The term includes
"lifts" and "hoists."

FIRE DOOR
A door and its assembly so constructed and placed as to give
the specific protection against the passage of fire.
FIRE PARTITION
A subdividing partition built for the purpose of preventing
the spread of fire, having a fire-resistance rating of two (2) hours,
constructed of masonry or concrete and supported on construction having
a fire-resistance rating of two (2) hours.
FIRE-RESISTANCE RATING
The time in hours that the material or construction will
withstand the standard fire exposure as determined by a fire test
made in conformity with the Standard Method of Fire Tests of Building
Construction and Materials. Materials or construction rated as "combustible"
shall not be acceptable for specific ratings of over one (1) hour.
FIRE WALL
A wall which subdivides a building from foundation to and
above the roof to a height of three (3) feet, to restrict the spread
of fire, constructed of masonry or concrete.
FLAT SLAB
A reinforced concrete slab, generally without beams or girders,
used to transfer loads to supporting members.
FLOOR AREA
Floor space enclosed by exterior walls, fire walls, fire
partitions or by a combination of them.
FOOTINGS
A structural unit used to distribute loads to the bearing
materials.
FOUNDATION WALL
A wall or pier extending at least three (3) feet below the
established grade, resting on footings and serving as a support for
any other structural part of a building.

HOME ENERGY RATING SYSTEM (HERS)
Defines a standard measurement of a home’s energy efficiency
obtained through a review of the home and on-site inspection to identify
its energy characteristics, including insulation levels, window efficiency,
wall-to-window ratios, the heating and cooling system efficiency,
the solar orientation of the home and the water heating system. Performance
testing, including a blower door test for air leakage, a duct blaster
test for duct leakage and Combustion Safety Testing are required as
part of the rating.

LIME MORTAR
A mixture of slaked or hydrated lime and sand.
LOT
A portion or parcel of land considered as a unit, devoted
to a certain use or occupied by a building or group of buildings united
by a common ownership or use.
LOT LINE
Any line dividing one lot from another or from the street
or other public space.
MASONRY
Construction consisting of brick, stone, concrete, hollow
concrete block, solid concrete block or other material approved after
test, or a combination of these materials combined with mortar.
MULTIPLE DWELLING
A building designed for and occupied as a house or residence
in whole or in part by three or more family units living independently
of each other, including apartment houses, rooming houses and hotels.
OCCUPIED
Shall be construed as though followed by the words "intended,
arranged or designed to be occupied."
OWNER
The actual owner of a plot or building, or his duly authorized
agent or attorney, a purchaser, devisee, fiduciary and any person
having a vested or contingent interest in the property in question.
PASSAGEWAY
An enclosed hallway or corridor connecting a required exit
to a street or other open space leading to a street when such exit
does not lead to a street.
PENTHOUSE
An enclosed structure other than a bulkhead, extending not
more than twelve (12) feet above a roof.
PERSON
An individual, corporation or copartnership.
PLACE OF ASSEMBLY
A room or space in which provision is made for seating seventy-five
(75) or more persons for other than occupational purposes, including
any occupied room or space in the same story connecting therewith
or in stories below or above where entrance is common to the rooms
or spaces.
PUBLIC NUISANCE
The use or maintenance of any building, residence, premises,
structure, place or lot, developed or undeveloped, for the furtherance
of prohibited conduct.

REPAIR
The replacement of existing work with the same kind of material,
but not including any additional work affecting structural safety,
exit facilities or elevator assemblies. (See "alteration.")
SELF-CLOSING
Closing automatically after being opened for use.
SERVICE STATION
Any structure or premises or portion thereof in which volatile
flammable oil is stored or furnished to motor vehicles and in which
not more than three (3) motor vehicles are stored or serviced.
SHAFT
An enclosed shaftway or space extending through one (1) or
more stories of a building, connecting a series of two (2) or more
openings in successive floors or floors and roof.
SPRINKLERED
Equipped with an approved system of automatic sprinklers.
STAIRWAY
One (1) or more flights of stairs and the necessary landings
and platforms connecting them to form a continuous and uninterrupted
passage from one story to another in a building.

STREET
Any thoroughfare dedicated or devoted to public use, including
sidewalks.
STRUCTURE
See "building." A combination of materials to form a construction
that is safe and stable, including stadiums, tents for public assembly
or amusement performances, reviewing stands, platforms, stages, observation
towers, sheds, radio towers, gasoline pumps, retaining walls, bins,
fences, display signs and billboards. The term "structure" shall be
construed as though followed by the words "or parts thereof" and is
used synonymously with the term "building."
THERMAL ENVELOPE REQUIREMENTS
Requirements under the program for the construction of the
building exterior shell including walls, foundation, floors, ceiling,
windows, doors and roof that separate the interior environment from
the exterior environment.
