This Article shall be known as the "Sanitation, Garbage and Rubbish Disposal Ordinance."
For the purposes of this Article, the following terms, phrases or words shall have the meaning ascribed to them in this section, except where the context in which the word is used clearly indicates otherwise:
ASHES
Cold residue from the burning of wood, coal, coke or other combustible material.
BOROUGH
The Borough of Economy, the Mayor and the Borough Council.
BOROUGH COLLECTOR
That individual, partnership, firm, corporation or business entity designated by the Borough Council by means of an independent contract, as the person having the exclusive right to collect garbage and rubbish within the Borough, but shall not be construed as meaning that said person is an employee, official or representative of the Borough.
COMMERCIAL
The non-business use of premises other than as a residence.
DWELLING
A building used for residential purposes.
DWELLING UNIT
One or more rooms in a dwelling which room or rooms have fixed cooking facilities arranged for occupancy by one person, two or more persons living together, or one family.
GARBAGE
Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of foods.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
RUBBISH
Includes glass, metal, paper, plant growth, wood or similar nonputrescible solid wastes.
A. 
It shall be unlawful for any person, other than such person as is duly authorized by the Borough to collect and haul garbage and rubbish of any nature within or from the Borough or to haul except in a truck utilizing a packer type waterproof body or in another type of truck approved by Council.
B. 
The Borough Council shall, by resolution, designate one person as the Borough collector. Said Borough collector shall have the exclusive privilege and obligation to collect and haul garbage and rubbish within the Borough.
(1) 
The privilege may be renewed by Council for such additional period and upon such terms as Council deems wise with or without competitive proposals.
(2) 
Bond or other security in an amount set by Council in a form satisfactory to Council must be given.
(3) 
Insurances of a type and in an amount set by Council shall be in effect.
A. 
Preparation of garbage and rubbish.
(1) 
All garbage shall be drained of liquid and wrapped in paper before being placed in the container.
(2) 
Newspapers, magazines and other printed matter, not placed in containers, shall be securely tied in bundles not exceeding 40 pounds in weight.
B. 
Garbage and rubbish containers.
(1) 
All garbage and all other rubbish, when possible, shall be placed in thirty-two-gallon containers, or thirty-two-gallon plastic bags.
(2) 
Containers containing garbage shall be covered with a lid which fits securely and prevents access by flies, other insects and animals.
C. 
Accumulation of garbage and rubbish.
(1) 
No person shall place any garbage and rubbish upon any street, alley, walk or other public place or upon any private property, except in proper receptacles for collection. Where the garbage and rubbish is of such size and shape as not to permit its being placed in containers, it may be set next to the container.
(2) 
No person shall deposit garbage or rubbish in any stream or body of water. In no event shall garbage or rubbish be placed on the property of another resident.
(3) 
No person, except the occupants of the property on which the container is placed and an authorized collector shall remove the lids of the container and/or remove the contents thereof.
(4) 
Garbage or rubbish of a highly inflammable or explosive nature, or highly infectious or contagious garbage or rubbish shall not be stored for collection.
(5) 
No person shall allow garbage or rubbish to accumulate so that it shall or may afford food, harborage or breeding areas for rats, flies or other vectors, whether that be inside or outside a building or dwelling.
D. 
Location of containers.
(1) 
Garbage and rubbish containers shall be placed for collection at ground level on the property, not within the cartway of a street or alley and accessible to and not more than 10 feet from the side or curb of the street or alley from which collection is made.
(2) 
It shall be unlawful to permit containers to remain at the curbside or along a public right-of-way for periods longer than 10 hours prior to or following regularly scheduled collection days.
A. 
Garbage and rubbish collected by the Borough Collector will be made at least once a week except where conditions beyond the control of the collector prevent collection. Businesses disposing of their own garbage and rubbish shall provide for collection at intervals short enough to prevent unsafe, unsightly or unsanitary accumulations of garbage and rubbish.
B. 
The Borough Collector will collect all garbage and rubbish placed at the designated collection site.
C. 
The following items will not be collected by the Borough collector:
(1) 
Tree stumps.
(2) 
Vehicle motors or crank shafts or tires, or auto parts or tires.
(3) 
Explosives or flammable liquids.
(4) 
Bricks, concrete or concrete blocks.
(5) 
Building materials.
(6) 
Ashes.
D. 
The following items and others too large for usual pickup will be picked up weekly by the collector: appliances, furniture, plumbing fixtures, hot-water heaters, furnaces, radiators, bed springs, bicycles, large metal toys and similar items.
E. 
The collection practices of the Borough Collector and any other person removing garbage and rubbish from the Borough by special permit of the Borough shall conform to all applicable rules and regulations of the Borough and the Commonwealth of Pennsylvania and any contract or contracts between the parties and all practices shall be subject to review or approval of Borough Council.
A. 
Residential.
(1) 
The fees for collection and disposal of garbage and rubbish from residential property shall be at a rate set by Council per two thirty-two-gallon containers per quarter for the first two containers. Beginning with the third container there shall be a rate set by Council per thirty-two-gallon container per quarter. All fees charged shall be set and approved by Council by resolution. There shall be reduction of fees and alteration of collection practices for aged or disabled residents as determined by Council.
(2) 
The fees herein provided for are owed to and shall be billed by the collector and paid quarterly by the resident of the dwelling unit to the collector. The fee for garbage and rubbish disposal shall be the responsibility of the dwelling unit resident.
(3) 
For the purposes of this section (§ 97-11), a "quarter" shall be defined as any one of the following three-month calendar periods: January, February, March; April, May, June; July, August, September; October, November, December.
Any person, firm or corporation violating any of the provisions of this Article shall, upon conviction therefor, be sentenced to pay a fine of not more than $100 and costs of prosecution and, in default of payment of such fine and costs, to imprisonment for not more than 30 days, provided that each day's violation of any of the provisions of this Article shall constitute a separate offense.
The Borough collector will post a performance bond in an amount set by Council and furnish evidence of liability and worker's compensation coverage satisfactory to Council.
