This Article shall be known as the "Sanitation, Garbage and Rubbish
Disposal Ordinance."
For the purposes of this Article, the following terms, phrases or words
shall have the meaning ascribed to them in this section, except where the
context in which the word is used clearly indicates otherwise:
ASHES
Cold residue from the burning of wood, coal, coke or other combustible
material.
BOROUGH
The Borough of Economy, the Mayor and the Borough Council.
BOROUGH COLLECTOR
That individual, partnership, firm, corporation or business entity
designated by the Borough Council by means of an independent contract, as
the person having the exclusive right to collect garbage and rubbish within
the Borough, but shall not be construed as meaning that said person is an
employee, official or representative of the Borough.
COMMERCIAL
The non-business use of premises other than as a residence.
DWELLING
A building used for residential purposes.
DWELLING UNIT
One or more rooms in a dwelling which room or rooms have fixed cooking
facilities arranged for occupancy by one person, two or more persons living
together, or one family.
GARBAGE
Putrescible animal and vegetable wastes resulting from the handling,
preparation, cooking and consumption of foods.
PERSON
Any person, firm, partnership, association, corporation, company
or organization of any kind.
RUBBISH
Includes glass, metal, paper, plant growth, wood or similar nonputrescible
solid wastes.
Any person, firm or corporation violating any of the provisions of this
Article shall, upon conviction therefor, be sentenced to pay a fine of not
more than $100 and costs of prosecution and, in default of payment of such
fine and costs, to imprisonment for not more than 30 days, provided that each
day's violation of any of the provisions of this Article shall constitute
a separate offense.
The Borough collector will post a performance bond in an amount set
by Council and furnish evidence of liability and worker's compensation
coverage satisfactory to Council.
