No vehicle in excess of 10 tons' gross weight, including cargo, shall be permitted to travel upon any road, street or alley of the Borough of Economy, County of Beaver and Commonwealth of Pennsylvania, without a special permit, provided that this prohibition shall not apply to any road, street or alley in the Borough which is owned and maintained by the Commonwealth of Pennsylvania.
The terms and provisions of this chapter shall not apply to school buses, authorized emergency vehicles, public utility vehicles, vehicles owned and operated by the Borough of Economy and vehicles owned and operated by subcontractors of the Borough of Economy operating under a Borough contract. Vehicles used in the delivery of building materials and transportation of site excavation materials are exempt from the provisions of this chapter only to the extent of one load per day per site. Subsequent loads require the issuance of a permit as provided by § 175-20.

Upon application to the Borough Secretary, on a form supplied by the Borough, any person may seek a permit authorizing the movement of vehicles with a weight in excess of the posted weight limit. The procedure for seeking a permit, the type(s) of permits available, and the provisions regarding security shall be the same as set forth in Chapter 189 of the Pennsylvania Department of Transportation Regulations, which chapter is hereby incorporated and made a part of this ordinance by this reference thereto.
The Borough shall erect and maintain at each end of restricted Borough roads, streets and alleys signs bearing the words: "Road Restrictions - Vehicles Over Ten Tons Prohibited Without Permit."
Any person who violates any provision of this chapter shall be prosecuted under Section 4902(a) of the Vehicle Code [75 Pa.C.S.A. § 4902(a)] and, upon conviction, shall be guilty of a summary offense and shall be sentenced to pay a fine of $75 for each 500 pounds, or part thereof, in excess of 3,000 pounds over the maximum allowable weight.
