Any owner of property abutting or forming a part of any public street in the Town, and upon which property a new structure is to be built requiring a building permit, shall install at their own expense, and pursuant to specifications set by the Mayor and Council of the Town of Middletown or their designee, sidewalks on their property or on the land abutting their property for the entire length such property abuts or forms a part of any street.
No building permit shall be issued unless and until the plans for the sidewalk shall have been set forth on the plans submitted and approved by the Mayor and Council of the Town of Middletown or their designee.
Upon failure of the owner to install said sidewalks, the Town may install them and assess the cost thereof to the owner, payable by the owner within 60 days of notice by the Town to the owner. Assessments so made shall immediately constitute a lien on said property and shall bear interest thereon at the rate of 12% per annum, commencing on the 61st day following notice of the assessment. Notice pursuant to this subsection shall be deemed sufficient if delivered by first class mail to the owner of record as set forth on the Town tax rolls.

Sidewalks constructed pursuant to the provisions of this article shall be no less than six feet in width, shall be installed with a grade to permit drainage to the street and comply with all other requirements of the Mayor and Council of the Town of Middletown or their designee.
The provisions of Chapter 150, Subdivision of Land, concerning sidewalks shall, to the extent that they are not incompatible with the provisions of this article, survive and not be rescinded hereby.
"Public street" is defined as any public right-of-way 30 feet or wider in width.
