Whoever fails to answer any summons to appear
in the Court of the Alderman of the City of Rehoboth Beach to answer
for any violation of the Municipal Code of Rehoboth Beach, Delaware,
1974, after notice thereof shall be deemed guilty of a misdemeanor
and, upon conviction thereof, shall be fined, for the first offense,
not less than $50 nor more than $150 or be imprisoned for not less
than two days nor more than 10 days, or both, and shall pay the costs
of prosecution. For each subsequent offense, the said person shall
be fined not less than $75 nor more than $200 or be imprisoned for
not less than five days nor more than 15 days, or both, and shall
pay the costs of prosecution.
