A certain document, copies of which are on file in the office of the City Clerk, being marked and designated as the "Michigan Building Code, 2000 Edition," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Building Code for the City of Roseville, State of Michigan, for the control of buildings and structures as herein provided; and each and all of the regulations, supplements, amendments, provisions, penalties, conditions and terms of said Michigan Building Code, 2000 Edition, are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in §
88-3 of this chapter.
Ordinance No. 1050 of the City of Roseville,
entitled "Building Construction," and all other ordinances or parts
of ordinances in conflict herewith are hereby repealed.
The following sections are hereby revised as
follows:
A. Section 101.1, Title, is amended to read as follows:

101.1 Title: These regulations
shall be known as the "Building Code of the City of Roseville," hereinafter
referred to as "this code."

B. Section 112.3.1, Fee Schedule, is amended to read
as follows:

112.3.1 Fee Schedule: A fee for
each plan examination, building permit and inspection shall be paid
in accordance with the fee schedule established by resolution of the
Roseville City Council.

C. Section 116.4, Violation penalties, is amended to
read as follows:
|
116.4 Violation Penalties: Any
person who shall violate a provision of this code or shall fail to
comply with any of the requirements thereof or who shall erect, construct,
alter or repair a building or structure in violation of any approved
plan or directive of the Code Official, or of this code, shall be
guilty of a misdemeanor, punishable by a fine of not more than $500
or by imprisonment not exceeding 90 days, or both such fine and imprisonment.
Each day that a violation continues after a due notice has been served
shall be deemed a separate offense.

D. Section 117.2, Unlawful continuance, is amended to
read as follows:

117.2 Unlawful Continuance: Any
person who shall continue any work in or about the structure after
having been served with a stop-work order, except such work as that
person is directed to perform to remove a violation or unsafe condition,
shall be liable to a fine of not less than $100 but not more than
$500.

E. Chapter 11, Accessibility: delete this chapter.
F. Chapter 13, Energy Conservation: delete this chapter.
G. Section 3102, Signs: delete this section.
H. Section 3408.2, Applicability, is amended to read
as follows:

3408.2 Applicability: Structures
existing prior to June 29, 1996, in which there is work involving
additions, alterations or changes of occupancy shall be made to conform
to the requirements of this section or the provisions of Sections
3402.0 through 3407.0.

Nothing in this chapter or in the Building Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in §
88-3 of this chapter, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.

A. Agency designated. Pursuant to the provisions of the
state construction code, in accordance with Section 8b(6) of Act 230,
of the Public Acts of 1972, as amended, the Building Official of the
City of Roseville is hereby designated as the enforcing agency to
discharge the responsibility of the City of Roseville under Act 230,
of the Public Acts of 1972, as amended, State of Michigan. The City
of Roseville assumes responsibility for the administration and enforcement
of said Act throughout its corporate limits.
B. Code appendix enforced. Pursuant to the provisions
of the state construction code, in accordance with Section 8b(6) of
Act 230, of the Public Acts of 1972, as amended, Appendix G of the
Michigan Building Code shall be enforced by the enforcing agency within
the City of Roseville.
C. Designation of regulated flood-prone hazard areas.
The Federal Emergency Management Agency (FEMA) Flood Insurance Study
(FIS) entitled "Macomb County, Michigan (all jurisdictions)," dated
December 30, 2020, Index Panel Number 26099CIND0D, as well as the
Flood Insurance Map(s) (FIRMs) panel number(s) of 260990342H and 2609090344J,
effective 12-30-2020, are adopted by reference and declared to be
a part of Section 1612.3 of the Michigan Building Code.
