For the purpose of this chapter, the following terms, phrases, words
and derivations shall have the meanings given herein:
OCCUPANT
The individual, partnership or corporation that has the use of or
occupies any building, structure or vacant land.
OWNER
The individual, partnership or corporation that is listed on the
last tax assessment records of the building, structure or vacant land.
RATPROOFED
A cement rat wall being 24 inches deep and four inches thick.
RODENT
Any variety of species of rats.
RODENT EXTERMINATION
The elimination of rats from a building, structure or vacant land
by any or all of the accepted measures, such as poisoning, fumigation, trapping,
clubbing, etc., so that there is no evidence of rat infestation remaining.
RODENT HARBORAGE
Any condition which provides shelter or protection for rodents, thus
favoring their multiplication and continued existence in, under or outside
of a building, structure or vacant land.
It shall be unlawful for the owner or occupant to permit a condition
of rodent harborage to exist in any building or structure or on any occupied
or vacant land.
All owners and/or occupants in the City of Roseville, in order to prevent
rodent harborage, shall comply with the following requirements:
A. Stored material, such as firewood, coal, pipe, boxes,
etc., shall be neatly stored up off the ground at least eight inches and shall
be piled no higher than four feet above ground level and shall not be stored
in any front yard or required side yard.
B. All garbage and debris shall be stored inside unless
kept in metal or ratproof containers with tight-fitting lids and shall not
be placed at the curb until the day of collection.
C. All lots, vacant or occupied, and all buildings and structures
shall be kept free of all litter, garbage and debris at all times.
D. All accessory structures shall be erected on a cement
rat wall measuring a minimum of 24 inches deep and four inches thick. A cement
floor shall also be provided under the structure, measuring at least four
inches thick. Upon receipt of a written request by the owners of property,
the Director of Buildings and Inspection for the City of Roseville shall be
permitted to issue, in writing, variances from this provision upon a finding
in his or her reasonable discretion that practical difficulty exists complying
with the terms of this chapter and a reasonable alternative exists meeting
the spirit and intent of this chapter after reviewing the following:

(1) Size and character of the accessory structure.
(2) Dimensions of the proposed alternative rat wall barrier.
(3) Any other circumstances necessary to make a determination,
such as unique soil conditions or other considerations.
E. No person shall feed wild birds or animals with other
than commercially approved bird food, including seed, suet and other commercially
available feed in an approved container for the distribution of such bird
seed. Such container shall be elevated at least 48 inches above ground level.
In the event the City of Roseville, through one of its designated departments,
inspectors or employees, determines that the feeding of wild birds or animals
is causing and/or contributing to rodent harborage, it shall declare that
the lot from which feeding is occurring is a no-feeding zone for a period
of no less than 60 days.

F. Firewood regulations.

(1) Definitions. As used in this subsection:
FACE CORD
A quantity of firewood, as defined herein which, when piled in an
orderly manner, has the dimension of eight linear feet in length, four linear
feet in height, and not exceeding two linear feet in width for a total of
64 cubic feet.
FIREWOOD
Any part of a tree which has been severed from the ground and cut
into pieces for use in any indoor or outdoor wood burning device. This definition
shall include such wood as may have been trimmed or milled into untreated
lumber.
OUTSIDE STORAGE
The stockpiling of firewood, as defined in this section, in any place
except a location completely enclosed within a building, structure, garage,
barn or shed.
(2) Firewood storage prohibited. The outside storage of firewood
in any residentially zoned district or multiple family residential district,
as defined under the applicable provisions of the City of Roseville's
Zoning Code, is hereby prohibited except as provided hereinafter.
(3) Regulations for outside storage.
(a) Location on premises. No firewood shall be stored in
a front yard or required side yard. Storage shall be a minimum of six inches
from any fence.
(b) Manner of storage.
[1] All firewood shall be stockpiled in a neat and orderly
manner.
[2] Stockpiles shall be elevated not less than eight inches
above the ground and shall not exceed a total height of four feet, eight inches,
as measured from the ground.
(c) Number of face cords and length of stockpiles. The total
number of face cords permitted on the premises and the length of stockpiles
shall be no greater than two face cords and no greater than 16 feet in length.
(4) The City Manager, or his or her designee may deviate
from the requirements set forth in this subsection when taking into account
certain extenuating circumstances, such as trees which have fallen on the
aggrieved person's property due to wind, storm, or other similar acts
of God, or proof, if it can be provided, that an unusual amount of wood burning
and storage is necessary for health or medical reasons.
The City of Roseville, through one of its designated departments, inspectors
or employees, shall be authorized and directed to inspect every reported rodent-infested
building, structure or vacant land and to make a determination of whether
there is rodent harborage or infestation.
When any structure, building or vacant land is found to be in violation
of this chapter, the owner and/or occupant shall be notified in writing, by
first-class mail, of such violation and corrective measures that are to be
taken to eliminate such violation and that said notice shall be complied with
within a specified period of time, being no less than 10 days. Such notice
may be posted in a conspicuous part of the building, structure or vacant land.
A. When any structure, building or vacant land is found
to have unlawful accumulations of any materials, debris or garbage which may
constitute a condition of rat harborage, the owner and/or occupant shall be
notified to store such accumulations as required by this chapter or to remove
such accumulations from the property.
B. When any structure, building or vacant land is found
to be rat-infested, the owner and/or occupant shall be notified to take immediate
rodent extermination measures and to continue same until all evidence of rat
infestation is eliminated.
Upon the failure of any owner and/or occupant to comply with the directives
of any notice issued by the City of Roseville pursuant to this chapter, the
City of Roseville shall be authorized to take whatever measures are necessary
to remove unlawful accumulations and to exterminate for rats, and the costs
thereof shall be collected in the manner hereinafter provided.
The owner of such property as listed on the last tax assessment roll
shall be notified of the amount for such costs as incurred by the City of
Roseville, by first-class mail, at the address shown on the records. Upon
failure of the owner to pay same within 30 days after mailing of the notice
of the amount, the City of Roseville shall add same to the next city tax roll,
and it shall be collected in the same manner as provided by law for the collection
of taxes by the City of Roseville.

Any person or entity violating the provisions of this chapter shall be punished as provided in Chapter
1, General Provisions, Article
