No person or corporation shall conduct a circus, carnival or other traveling shows to be conducted out of doors or under tents and not in a licensed theater or other building without having first obtained a license for the same from the Township Clerk, in accordance with the provisions of this section.
Licenses shall be limited to charitable and nonprofit organizations, 50% of whose membership are residents of the Township of Hillside.
The fee for a license shall be the sum of $50.
The application for a license shall be submitted to the Police Chief, the Fire Chief and the Health Officer, who shall investigate the application and indicate thereon their approval or disapproval. The Police Chief, the Fire Chief and the Health Officer shall, respectively, satisfy themselves as to the public safety, the sanitary requirements and conditions and the fire hazards involved and shall make reports thereon, together with their approval or disapproval, within 10 days after the application has been submitted to them. Upon their return of the application to the Township Clerk, the Township Clerk shall then refer the application for a license to the Township Council for consideration and determination; upon favorable action of the Township Council, the license shall be issued. In the event of approval of the license, the Police Chief, the Fire Chief and the Health Officer shall make continuing inspections of the place of the circus, carnival or traveling show, in order to ensure compliance with the laws and the public safety hazard, the sanitary requirements and conditions.
No license shall be issued unless proof of adequate and satisfactory insurance coverage is submitted along with the application for a license. The amount of insurance required shall be determined by the Township Council.
No license shall be issued unless the applicant has shown proof of full compliance with applicable state statutes, particularly N.J.S.A. 34:15-71, regarding workers' disability insurance, pursuant to N.J.S.A. 40:52-1.1.

No circus, carnival or other traveling shows shall be conducted or operated between the hours of 11:00 p.m. and 9:00 a.m.
Any person, firm or corporation who shall violate any of the provisions of this chapter shall, upon conviction, be punishable by a fine not exceeding $1,000; imprisonment for a term not exceeding 90 days; and/or a period of community service not exceeding 90 days.
