The township has reacquired property located
at 1435 Liberty Avenue, in the Township of Hillside, State of New
Jersey (Block 1102, Lot 13 on the Tax Map of the Township of Hillside)
(the property) which it had previously conveyed in fee simple determinable
to the United States War Veterans Memorial Building Association of
Hillside, New Jersey (the Veterans Association), a not-for-profit
corporation of the State of New Jersey. The Association is comprised
of the following organizations: the Veterans of Foreign Wars, Post
No. 151; the American Legion, Post No. 50; the Disabled American Veterans,
Post No. 55; the Jewish War Veterans, Post No. 78; and the Ladies
Auxiliaries of the foregoing organizations.
In order to effectuate the township's reacquisition
of the property, a bargain and sale deed with covenants as to grantor's
acts was made between the Veterans Association and the Township of
Hillside on December 9, 1998.
The Veterans Association shall be permitted
to utilize the property in the following manner, subject to the prior
approval of either the Mayor or the Business Administrator of the
township: to conduct an annual memorial service (and related activities);
to conduct occasional fund-raising activities; to conduct monthly
meetings of the Veterans of Foreign Wars, American Legion, Disabled
American Veterans and Jewish War Veterans; and to store patriotic
items of the organizations, as well as records and related items.
The Mayor or Business Administrator of the township
may, at their option, designate alternate locations, dates and times
for the monthly meetings of the veterans organizations which comprise
the Veterans Association.
The Veterans Association shall be permitted
to maintain two plaques on the wall. In the event that the township
determines to demolish the building, the plaques shall be removed
and installed in the Municipal Building of the Township of Hillside,
in a location to be determined by the Mayor or Business Administrator
of the township.
The township has determined that the Veterans
Association's occasional use of the property would further an important
public purpose, in that it would promote patriotism and contribute
to the continued viability of the Association itself.
The Veterans Association has represented to
the township that any funds raised through the Veterans Association's
occasional use of the property will be utilized solely for the proper
purposes of the Veterans Association or the organizations which comprise
same.
The consideration for the Veterans Association's
use of the property shall be $1 and other good and valuable consideration.
The township is hereby authorized by law to
take the foregoing actions.
All ordinances or parts of ordinances inconsistent
herewith accordingly repealed to the extent of any such inconsistency.
This ordinance shall take effect 20 days after
final passage by the Township Council and approval by the Mayor and
according to law.
