The Board of Trustees of the Incorporated Village
of Rockville Centre has found that the use of private (nonmunicipal)
garbage, ash and waste carters or removers by premises within the
Village has greatly increased.
B.Â
Therefore, the Board declares and finds it to be in
the public interest and for the public good and safety to preserve
property values, promote the health, peace and safety of the residents
and merchants and for other aesthetic considerations to provide for
the regulation of the private garbage carters which provide services
within the boundaries of the Incorporated Village of Rockville Centre.
As used in this article, the following words
and phrases shall have the following meanings:
A person or entity engaged in the business of removing garbage,
ashes or refuse from premises or places.
A carter which is not owned or employed by the Incorporated
Village of Rockville Centre.
The Incorporated Village of Rockville Centre.
A.Â
All private carters which perform work or provide services to any premises or place within the Village shall first obtain a license as is provided for in Article I above before commencing operation within the Village boundaries.

Private carters shall have and demonstrate that they
have workers compensation insurance coverage for all its employees
who work or provide services within the Village.

(1)Â
All private carters performing work or providing services
to any premises or place within the Village must demonstrate, in written
format, compliance and that they have an active recycling program,
prior to issuance of an operating Village license.
(2)Â
The recycling program must address and provide for
the recycling of all recyclable material as identified by the Superintendent
of Public Works. The Superintendent of Public Works is empowered to
amend the list of recyclables, upon written notification to all private
carters. Following proper notification, private carters must implement
all changes within a thirty-calendar-day period. Failure to implement
required changes to the recycling effort shall be sufficient reason
to suspend the private carter's operating license within the Village.

All licensed private carters operating within the
Village must submit a monthly recycling report, in written format,
to the Superintendent of Public Works. Said report is due on the fifth
calendar day of the following month. The recycling report must identify
all recyclables and their respective weights and the total monthly
weight associated with all solid waste collected and removed by the
private carter from within the Village. Failure to submit the monthly
report, as cited, shall be sufficient reason to suspend the private
carter's operating license with the Village.

Persons or entities engaged in the business of removing
garbage, ashes or refuse from premises located within the Village
shall perform such services only:

In no case, however, shall the permitted hours of
collection for private carters be less than the hours that the Rockville
Centre Sanitation Department utilizes for garbage, ash and refuse
collection.
A.Â
Any person or entity or any officer or official of
any entity which fails to comply with the provisions of this article
or any requirements thereof shall be guilty of a violation against
this article, which violation shall be punishable by a fine not to
exceed $250 or imprisonment for a period not to exceed 15 days, or
both. Any violation of this article shall constitute disorderly conduct,
and any person violating this article or any part thereof shall be
and is hereby declared to be a disorderly person.

Each violation of this article shall constitute a
separate and distinct additional violation.
In addition to the members of the Rockville
Centre Police Department, the Building Official and the Superintendent
of Public Works, and each of their delegates, are hereby given the
power and authority to enforce the provisions of this article.
