GENERAL REFERENCES
Alcoholic beverages — See Ch. 77.
As used in this chapter, the following terms shall have the meanings indicated:
BOROUGH PROPERTY
A. 
Property owned by, leased to, or used by Columbia Borough and devoted to recreational activities, including but not limited to public parks, parkways, playgrounds, play fields, swimming pools, recreational centers and gymnasiums.

B. 
Property owned by, leased to or used by Columbia Borough for the purposes of providing municipal services, including but not limited to the Municipal Building, Borough sheds, sewer plant and parking lots.
C. 
All other property wheresoever located, owned by, leased to or used by Columbia Borough.
PERSON
Includes any individual, firm, partnership, corporation or association, and any servant, agent, assistant, employee or representative thereof.
Within the limits of any Borough property, it shall be unlawful for any person to either perform or permit to be performed any of the following acts:
A. 
Drink or be under the influence of malt or brewed beverages, spirituous liquors or wine.
B. 
Carry or possess any malt or brewed beverages, spirituous liquors or wine.
C. 
Injure, deface, destroy, tamper with, displace or remove any signs, notices or placards, whether temporary or permanent, or other structures or equipment, facilities or property or any appurtenances whatsoever, either real or personal.
D. 
Smoke in areas where forbidden by signs.
E. 
Throw or deposit cans, bottles, broken glass, paper or rubbish of any description except in containers provided for the same.
F. 
Discard any refuse or offensive matter or substance of any kind.
G. 
Commit any public nuisance.
A. 
Unless otherwise determined and posted by Borough Council, Borough property devoted to recreational activities shall be closed between the hours of 10:00 p.m. and 5:00 a.m. Any such property or any section or part of such property may be declared closed to the public by the Borough Council or by the custodian of such property at any time and for any interval of time, either temporarily or at regular or stated intervals. No person, other than authorized supervisors, police, guards, or similar personnel, shall occupy, frequent or use such property between the hours of 10:00 p.m. and 5:00 a.m. or during such other hours when such property may be closed to the public, except when such property is being used for a special event for which a permit has been issued by the Borough Council.

B. 
Other Borough property shall be open to the public during such hours and at such times as are posted upon such property by order of the Borough Council.

It is within the discretion of the Borough Council to permit the use of Borough property during regular hours of operation or other times by individuals, entities or groups. Any person wishing to use any Borough property to the exclusion of other members of the public during regular hours of operation or hours other than the normal hours of operation shall apply to the Borough Council for a permit for such use. Any person to whom such a permit may be granted shall be liable for any loss, damage or injury sustained by any person for the reason of negligence of the person or persons to whom such permit may be granted, their agents or employees.
The Borough Council may make and promulgate such rules and regulations as may be necessary for the supervision, maintenance and regulation of Borough property and shall enforce this chapter and all rules and regulations promulgated hereunder.

Any person who violates or fails to comply with the provisions of this chapter, or any regulations made hereunder, or with any sign or regulation posted on Borough property in accordance with the provisions of this chapter shall, upon conviction, be fined not more than $1,000 for each offense, plus costs of prosecution, and in default of payment of such fines and costs, shall be subject to imprisonment for a term not exceeding 30 days.
