The Town Board of the Town of Union Vale reserves unto itself, in its sole discretion, the power to equip, operate and maintain playgrounds and recreation centers in the Town of Union Vale.

It is the intention of the Town Board of the Town of Union Vale, in the interest of the public health, welfare and safety of the citizens of the Town of Union Vale, to prohibit trespassing and also to regulate and prohibit certain acts and conduct on all Town-owned property, grounds and improvements, including but not limited to Tymor Park and Tymor Park pool.
A. 
No person shall enter upon, remain on, conduct any activity on, be involved in any activity or be present on any Town-owned property or in any of the improvements thereon, including Tymor Park and Tymor Park pool, between the hours of 9:00 p.m. and 6:00 a.m. from May 20 until September 15 or between the hours of 6:00 p.m. and 7:00 a.m. from September 16 until May 19.

B. 
The foregoing provision shall not apply to those in the following circumstances:
(1) 
Persons who are present on Town-owned property or within any of the improvements on Town-owned property as part of any activity sponsored by the Town or for which permission has been granted by the Town Board or by any official of the Town designated by the Town Board to grant such permission.
(2) 
Persons attending any meeting of any board or committee of the Town of Union Vale or any judicial function of the Town Court.
(3) 
Persons parking motor vehicles on any of the designated parking lots on Town-owned property in connection with attendance at the meetings of boards or commissions of the Town of Union Vale or of the Town Court.
(4) 
Any Town official or any person meeting with any Town official on Town-owned property or within any of the improvements on the Town-owned property.

A. 
No person shall at any time operate or cause to be operated any motorized equipment or vehicles of whatsoever nature on any road, trail, pond, stream or elsewhere within any Town-owned property. Any use of such motorized equipment or vehicles without authorization is strictly prohibited.
B. 
No person shall at any time engage in fishing in any of the ponds or streams of Tymor Park without first obtaining proper authorization from the Town Clerk of the Town of Union Vale. Any fishing without such prior authorization is strictly prohibited.
C. 
Except as otherwise set forth in § 174-3B, any person who enters upon the Town-owned property during the hours of closure, remains unlawfully upon said property at any time or engages in either the specific prohibited activities set forth above or the more generic prohibited activities set forth below in § 174-5 shall be guilty of trespass in addition to any other charge pertinent to the particular prohibited activity or conduct.
In addition to the applicable rules and regulations set forth in other pertinent chapters, sections and provisions of the Code of the Town of Union Vale, the activity, acts and conduct set forth in this section shall be regulated and prohibited upon all Town-owned property and improvements as follows:
A. 
Parking of motor vehicles. All motor vehicles shall be parked upon designated parking areas.

B. 
Damage to Town property. No person shall damage, deface, destroy or disturb any Town property. No person shall damage, deface, destroy or disturb any Town structures, sign notices, equipment facilities, property or appurtenances whatsoever, either real or personal.
C. 
Firearms, fireworks and dangerous instruments. Firearms, including any type of weapon, fireworks, explosives and dangerous instruments, as defined by the Penal Law of the State of New York, are forbidden upon Town property and improvements at all times, unless carried by or in the possession of law enforcement personnel or authorized by special permit. D. 
Domestic animals. Domestic animals, including dogs and cats, must be on a leash and may be prohibited in designated areas marked by posted signs.[2]

E. 
Alcoholic beverages. Alcoholic beverages of any type are strictly prohibited upon Town property at any time, unless authorized by special permit.
F. 
Littering. Littering is prohibited, and all refuse, waste, garbage or offending material of any type shall be deposited at designated receptacles.[3]

G. 
Illegal substances. Use of illegal substances as defined by the Penal Law of the State of New York is strictly prohibited.
H. 
Hunting or molesting of animals. No person shall hunt, molest, harm, frighten, kill, trap, pursue, chase, tease, shoot or throw projectiles at any animal, wildlife, reptile or bird, nor shall any person have in his/her possession or remove the young of any wild animal or the eggs, nests or young of any reptile or bird.
I. 
Fires. Fires shall be restricted to those receptacles furnished for general public use. Use of privately owned fireboxes shall only be permitted in designated areas marked by posted signs. Any other fire is forbidden at all times. No person shall leave Town-owned property unless the fire he/she has ignited and/or controlled is completely extinguished.
This article shall be enforced by the Constable of the Town of Union Vale, the Zoning Administrator of the Town of Union Vale, all Code Enforcement Officials of the Town of Union Vale and any park or public attendant that may heretofore or hereafter be authorized to enforce this article by resolution of the Town Board. This article shall also be enforced by all law enforcement officials having jurisdiction within the Town of Union Vale.
Any person committing an offense against any provision of this article shall be guilty of a violation punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.

The Highway Department of the Town of Union Vale is hereby directed to install and post appropriate signs indicating that there shall be no trespassing between the hours of 9:00 p.m. and 6:00 a.m. from May 20 until September 15 or between the hours of 6:00 p.m. and 7:00 a.m. from September 16 until May 19.
