Except where otherwise indicated by context, the following definitions shall apply in the interpretation and enforcement of this chapter:
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind. This shall not apply to nonprofit organizations or associations organized for religious, charitable or educational purposes.
TOWNSHIP
The Township of Falls, Bucks County, Pennsylvania.
YARD SALE
Includes yard sale, garage sale, sidewalk sale, auction, rummage sale, annex sale or any other activity by which a person or persons not engaged in such sales as a commercial activity shall display items of personalty to other persons and invite the bidding or purchase thereof by said persons.
The following shall constitute restrictions on handles and signs placed within the Township relating to a yard sale:
A. 
Time of placement. The handbills or signs shall not be publicly placed within the Township any earlier than two weeks prior to the date scheduled for the yard sale.
B. 
Location. No handles or signs shall be placed upon private property of another without written consent having first been had or secured or no sign or handbill may be posted upon the private property of another on more than four yard sales per year.
C. 
Manner of affixing. No handbills or signs shall be permitted which are fixed in any way to utility poles or within any street or public right-of-way.
A. 
No person shall conduct more than four yard sales on a specific property within residential zoned districts in the Township during any calendar year.
B. 
No yard sales shall be of more than two days in duration.
C. 
All yard sales shall be conducted between the hours of 8:00 a.m. and 6:00 p.m. only.
The Code Enforcement Department shall cause to be investigated any violation of this chapter coming to his attention, whether by complaint or arising from his personal knowledge.
Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof, by summary proceedings, be sentenced to pay a fine of not more than $1,000 and the costs of the prosecution; however, each day's violation of any of the provisions of this chapter shall constitute a separate offense.
