No person, persons or corporation shall, in
the City of North Tonawanda, lay out, plat, dedicate or open any public
street upon or over any lands in said city where the same substantially
constitutes a continuation or extension of any other street in said
city unless such continuation or extension shall be of the same width
and upon the same lines extended in a straight line as the street
of which the new street is an extension or continuation.
Whenever the owner or owners of any tract or
parcel of land in the City of North Tonawanda shall have platted any
portion thereof and shall have laid out and dedicated or released
to the City of North Tonawanda any street or streets thereon which
shall not extend across said entire tract of land, all continuations
of said street or streets or extensions thereof must be laid out and
platted and such continuations or extensions thereof be so made as
shall, together with the portion thereof heretofore laid out, constitute
one continuous street of the same width as the portion of said street
then existing and so that the center line of said street extension
shall be a continuation in a straight line of the center line of said
street as theretofore existing, and no person, persons or corporation
shall plat, lay out or dedicate any such street or extension, except
of the width of and in the manner herein provided.
All maps, plats and plans of the subdivision
of any tract of land in the City of North Tonawanda showing streets
laid out thereon shall, before the same are filed in the County Clerk's
office and before lots are sold thereon according to said map, plat
or plan, be submitted for approval to the City Engineer of this city
and be approved by him by endorsement thereon of his approval, and
a copy or print of such map, plat or plan must be registered in the
office of the City Assessor.
The Common Council may, in special instances
when in its judgment the necessity of the case requires such action,
permit the laying out of a street or streets in such manner as it
may determine to be most feasible, but in such case, such permission
must be by resolution of the Board duly entered in its minutes and
approved by the Mayor as other resolutions are approved.
Any person violating any of the provisions of
this ordinance shall be guilty of a misdemeanor.
