A. 
This chapter shall be known as the "Electrical Code of the Town of Victor."
B. 
This chapter shall provide the basic method for administration and enforcement of the Electrical Code in the Town of Victor outside the village limits and shall establish power, duties and responsibilities in connection therewith. Since there is danger to life and property inherent in the use of electrical energy, this Electrical Code of the Town of Victor is enacted to regulate the installation, alteration, extension, relocation or replacement of wiring for electric light, heat or power and signal systems operating on fifty (50) volts or more in or on all real property within the Town of Victor outside the village limits.
A. 
There are hereby designated and created the duties of electrical inspector to administer and enforce the Electrical Code of the Town of Victor.
B. 
The duties of electrical inspector shall be the responsibility of the Code Enforcement Officer of the Town of Victor. The electrical inspector shall authorize the issuing of a certificate of compliance when electrical installations and equipment are in conformity with this chapter.
All electrical installations, alterations, extensions, relocations or replacements heretofore mentioned shall be made in conformity with the latest edition of the National Electrical Code, except when the provisions of this chapter or any other local law or ordinance or the New York State Uniform Fire Prevention and Building Code or New York State Energy Conservation Construction Code shall be recognized as proper compliance with this chapter. The requirements of the National Electrical Code shall be those known as the "National Fire Protection Association Document No. 70," as approved and adopted by the American Standards Association.
The Town Board shall:
A. 
Hear any written complaint that an inspector or agency is incompetent or unqualified or shows misconduct.
B. 
Determine whether to revoke or suspend agency privileges or take other action on a complaint.
It shall be the duty of the Code Enforcement Officer to enforce all the provisions of this chapter, all violations of or deviations from or omissions of the electrical provisions of the National Electrical Code, all local laws and ordinances and the New York State Uniform Fire Prevention and Building Code or the New York State Energy Conservation Construction Code as referred to in this chapter insofar as any of the same apply to electrical wiring.
An authorized electrical inspector's agent shall:
A. 
Inquire and note on its application form if any other agency has accepted an application for inspections.
B. 
Not accept an application from any person who has made application to another agency or has received notice of violation from another agency.
C. 
Maintain adequate records of inspections for a minimum of one (1) year.
D. 
Make available records of inspections.
E. 
Leave a removable approval or disapproval sticker at the site after each inspection to prevent delays.
F. 
Mail a copy of all inspection reports to the customer and Building Department within twenty-four (24) hours after inspection. Inspection reports shall include all violations or deviations from or omissions of the electrical provisions of codes, laws or ordinances as referred to in this chapter insofar as any of the same apply to electrical wiring.
G. 
Maintain an office in the Monroe-Ontario County area.
H. 
Maintain office hours from 9:00 a.m. to 4:30 p.m. on normal business days to receive inspection requests and to answer customer's questions.
I. 
Maintain a minimum of two (2) qualified inspectors to do inspections in the Town of Victor outside the village limits if needed.
J. 
Provide the town with applications.
K. 
Bill customers and receive fees and serve without compensation from the Town of Victor.
L. 
Report any changes in business practices or ownership to the Town Clerk.
M. 
Be approved by Rochester Gas and Electric to do electrical inspections.
N. 
Be insured and submit certificates of insurance to the Building Department for workers' compensation, employers' liability and general liability for a minimum of one million dollars ($1,000,000.).
O. 
Make inspections requested by any official of the town for existing buildings and submit a written inspection report at no cost to the town.
P. 
Take all responsibility for any damages to persons or property caused by defect.
Q. 
Accept no applications for electrical inspections until a permit for such work is first obtained from the Victor Building Department.
An inspector shall:
A. 
Be knowledgeable of principles of electricity, applicable codes, construction practices and right-of-entry laws.
B. 
Require that all electrical improvements meet the standards of the latest adopted and amended codes, i.e., the New York State Uniform Fire Prevention and Building Code, National Electrical Code, Occupational Safety and Health Administration, Town of Victor codes, etc.
C. 
Not engage in the work of an electrician.
D. 
Not be engaged by nor have any interest in any wholesaler or retailer of electrical goods.
E. 
Not inspect electrical work in his own home if he lives in the Town of Victor outside the village limits.
A. 
Any electrical inspection agency approved pursuant to this chapter must furnish proof of liability coverage protecting the Town of Victor and/or, by contract, must agree to indemnify and hold harmless the Town of Victor from any and all claims arising out of his performing any function pursuant to this chapter.
B. 
The approval of an electrical installation or issuance of certificate of compliance by a party designated pursuant to this chapter shall exempt a person from prosecution of this chapter or a violation of the New York State Uniform Fire Prevention and Building Code or New York State Energy Conservation Construction Code to the extent that the same shall apply but shall not in any way create or impose any liability on the Town of Victor.
This chapter shall not be construed to relieve from or lessen the responsibility of any person owning, operating, controlling or installing any electrical wiring, devices, appliances or equipment for loss of life or damage to person, persons or property caused by any defect therein, nor shall the Town of Victor, outside the village limits, or an authorized electrical inspection agency be deemed to have assumed any such liability by reason of any inspection made pursuant to this chapter.
The provisions of this chapter shall not apply to the electrical installations in mines, ships, railway cars, automotive equipment or the installation of equipment employed by a railway, electrical or communication utility in the exercise of its function as a utility and located outdoors or in buildings used exclusively for that purpose. This chapter shall not apply to any work involved in the manufacture, assembly, test or repair of electrical machinery, apparatus, materials and equipment by a person, firm or corporation engaged in electrical manufacturing as their principal business.
It shall be a violation of this chapter for any person, firm or corporation to install or cause to be installed or to alter electrical wiring for light, heat or power in or on properties in the Town of Victor outside the village limits until a building permit is obtained and an application for inspection has been filed with an approved electrical inspection agency. It shall be a violation of this chapter for a person, firm or corporation to connect or cause to be connected electrical wiring in or on properties for light, heat or power to any source of electrical energy supply prior to the issuance of a temporary certificate or a certificate of compliance by an authorized electrical inspection agency.
A violation of this chapter is an offense punishable by a fine not exceeding two hundred fifty dollars ($250.) or by imprisonment for not more than one (1) month, or by both fine and imprisonment. For the purpose of conferring jurisdiction upon courts and judicial offices, failure to comply with this chapter shall be deemed to be a violation. Each week the violation continues shall constitute and be deemed an additional violation.
A. 
This chapter shall be enforced by the Code Enforcement Officer of the Town of Victor.
B. 
In addition to any penalty provided by this chapter, the Code Enforcement Officer may institute an action or proceeding in the local Justice Court by issuance of an appearance ticket, authorized by Resolution No. 195 of August 13, 1979, and as defined in § 150.20 of the Criminal Procedure Law, to compel compliance with or to restrain violations of this chapter.
