As used in this chapter, the words and phrases listed below
shall be deemed to have the following meanings:
APPLICANT
Any person making a request in writing for any water service
to be rendered or furnished by the Town of Victor Central Water District.
CONSUMER or CUSTOMER
The person legally or equitably responsible for payment of
charges for water or other facilities and services furnished by the
Town of Victor Central Water District.
MCWA
The Monroe County Water Authority, the lessor of the Town
of Victor Central Water District.
OCCUPANT
The person actually in possession or control of any premises
or part thereof who is a consumer.
OWNER
The person who has legal or equitable title to any premises.
PERSON
An individual, firm, association or corporation.
PREMISES
A.
A building owned or leased by a customer and occupied as a residence
or a place of business.
B.
Each unit of a multiple dwelling or building separated by a
solid vertical partition wall, occupied by one family or one firm
or company as a residence or place of business.
WATER DISTRICT
The Town of Victor Central Water District, as leased and
maintained and operated by the Monroe County Water Authority.
The Monroe County Water Authority is responsible for the operation
and maintenance of the Town of Victor Central Water District. As such,
the MCWA's rules and regulations, to the extent applicable, shall
be complied with by all consumers and customers of the Town of Victor
Central Water District even where such rules and regulations are not
specifically cited or otherwise set forth herein.
New service connections shall only be installed in accordance
with the Monroe County Water Authority rules and regulations.
All connections from the curb stop to the water meter shall
be completed by the consumer at his/her own expense.
The plumber or any other person designated and employed by the
owner of the premises will be considered the agent of said owner.
Persons desiring a supply of water shall make application directly
to the MCWA.
The service pipe between the curb stop and the meter shall be
composed of such material and shall be of such quality and construction
as required by the MCWA's rules and regulations.
The curb stop controlling any service may be opened only by
the MCWA or its agent.
Upon reasonable notice and presentation of credentials, an MCWA
representative or a Town representative may enter any premises where
water is supplied by the Water District or where application is made
for such supply in order to inspect water-related infrastructure.
All water furnished through service pipes shall be metered.
No meters shall be set, removed or disturbed except by the MCWA. Meters
shall be furnished and installed by the MCWA after payment of all
appropriate fees. As determined by the MCWA, a meter pit may be required
(at the owner's expense) and shall be located at the street right-of-way
on private property.
All water shall be paid for according to the water rates set
therefor.
No persons except authorized representatives of the MCWA shall
operate water main valves.
The MCWA rules and regulations address backflow and related
issues. Such rules and regulations shall be complied with.
The MCWA, as the water supply permittee and in accordance with
state law, implements a water conservation program. The provisions
of such program are within the MCWA's rules and regulations and
shall be complied with.
The Town Board hereby authorizes the Town Supervisor to declare
an emergency ban on outdoor water use upon a determination that such
a reduction is necessary in order to meet the water needs of the Town.
A ban on outdoor water usage will be declared in accordance with the
emergency communications procedures adopted by the Town.
