Consent, permission, right and privilege be
and are hereby given and granted to Pennsylvania and Southern Gas
Company, a Delaware corporation, operating under and by virtue of
the laws of the Commonwealth of Pennsylvania, its successors and assigns
to furnish, supply and distribute gas to or for the public for compensation
for heat, light, fuel and power purposes, within the limits of the
Township of Athens, County of Bradford and Commonwealth of Pennsylvania,
and for such purposes to construct, lay, place, maintain, alter, inspect,
repair and operate conduits, ducts, mains, pipes, lines, manholes
and other necessary appurtenances and appliances, on, under, over,
through, across and along the streets, roads, lanes, alleys, highways
and other public places within the limits of the Township of Athens,
County of Bradford and Commonwealth of Pennsylvania.
Pennsylvania and Southern Gas Company, its successors
and assigns shall agree not to open or encumber any more of any street,
road, lane, alley, highway or any other public place than will be
necessary to enable it to perform its necessary operations with proper
economy and efficiency; nor shall it permit such opening or encumbrance
to remain for a longer period than shall be necessary to do the work;
provided, further, that the company shall be subject to all reasonable
regulations of a general nature governing the use of the streets,
roads, lanes, alleys, highways and other public places in the Township
of Athens that are now in effect, or that may hereafter be enacted,
including all regulations that may be enacted governing the size and
fees in connection with road openings and replacing the surface of
said road and governing the locations of the openings, provided that
the terms, conditions and regulations prescribed therein do not impair
or abridge the permission contained in this ordinance.
The Pennsylvania and Southern Gas Company shall,
under its seal and by its proper officers, within 60 days from the
date of the final enactment of this ordinance, signify, in writing,
its acceptance of all the terms, conditions, regulations and restrictions
herein contained, in default of which this ordinance shall become
null and void and of no effect.
This ordinance shall take effect at the expiration
of 30 days from the date when a certified copy thereof shall have
been filed in the office of the Secretary of the Pennsylvania Public
Utility Commission, provided that if said Commission shall, prior
to the expiration of such period, institute a proceeding under the
provisions of Section 911 of the Public Utility Law affecting its
validity, this ordinance shall become effective only upon approval
of said Pennsylvania Public Utility Commission.
This ordinance shall continue
perpetually from and after date of acceptance of the provisions hereof
by the company.
Any and all ordinances, or parts thereof, inconsistent
herewith shall be and they hereby are repealed.
