The Code Enforcement Officer shall be appointed by the Borough
Council. The Code Enforcement Officer may designate other Borough
staff persons to serve as Assistant Code Enforcement Officer(s). Such
designations shall be subject to the concurrence of Borough Council.
Assistant Code Enforcement Officers may serve with the same authority
and duties of the Code Enforcement Officer. The Code Enforcement Officer
shall not hold any elective office within the Borough, but may hold
other appointed offices.
The Code Enforcement Officer's duties and powers shall
include the following:
A. Administer
the Zoning Ordinance in accordance with its literal terms, including receive
and examine all applications required under the terms of this Code,
and issue or refuse permits within the provisions of this Code;
B. Conduct
inspections to determine compliance, and receive complaints of violations
of this Code; and
C. Keep
records of applications, permits, certificates, written decisions,
and variances granted by the Board, and of enforcement orders, with
all such records being the property of the Borough and being available
for public inspection; and
D. Review
proposed subdivisions and land developments for compliance with this
Code; and
E. Take
enforcement actions as provided by the Pennsylvania Municipalities
Planning Code, as amended, 53 P.S. §§ 10101 through
11202 et seq.
The Code Enforcement Officer shall comply with all state laws,
rules and regulations pertaining to his conduct in carrying out the
duties and responsibilities of the position.
Any fine or penalty imposed for the violation or violations
of a state law, Borough ordinance, rule or regulation pertaining to
the health, safety, welfare and morals of the community shall be in
accordance with the state law, Borough ordinance, rule or regulation
promulgated by the enabling legislative body enacting such law, ordinance,
rule or regulation.
