A. Definitions.
The following words or terms, for the purposes of this article, shall
be taken to mean as follows:
BULK TRASH
Bulk trash shall be the items that are listed as bulk trash in this definition and no other items. Bulk trash shall be any items that are either too large or too heavy to place in the standard containers that are required under §
60-5 of Chapter
60 of the Code of General Ordinances. The following items and no other items shall be considered bulk trash: air conditioner, TV antenna, barbecue grill (without the propane tank), bathtub, bed frame, bricks, box spring, cabinets, carpet (only if rolled and cut into four-foot lengths), chair, couch, sofa, dehumidifier, dishwasher, dryer, doors, down spouting, freezer (only if door is removed), golf clubs, lawn furniture, laundry tubs, luggage, trunks, metal (only if bundled and no more than three-foot lengths), mattress, padding (only if rolled), playground equipment (only if dismantled), pipes (only if bundled and shorter than three-foot lengths), plaster, refrigerator (only if doors are removed), radiator, stove, sink, TV, toilet, toys, trash cans, washer, water heater, wood (only if bundled and less than three-foot lengths) and lawnmowers if the fluids are drained and the tires removed. Any items that are too big to fit into a container prescribed by §
60-5 of Chapter
60 of the Code of General Ordinances that are not on the above-referenced list shall be considered trash that will not be picked up by the Borough of West Conshohocken, and the private homeowner will need to make private arrangements for the disposal of items that are not on the list.

GARBAGE
All refuse from animal and vegetable matter which has been
used for food for man (night soil excepted) or which was intended
so to be used.
HAZARDOUS WASTE
Any waste that is regulated by any state or federal governmental
agencies and classified by said agencies as hazardous waste.

INFECTIOUS WASTE
Any waste that is regulated by any state or federal governmental
agencies and classified by said agencies as infectious waste.

PERSON
An individual or individuals, company partnership, firm,
limited partnership or corporation.
RECYCLABLE MATERIALS
Materials which may be recycled, including, but not limited
to, glass (clear, brown or green), aluminum, steel and bimetal cans,
high-grade office paper, mixed paper, newspaper (including newspaper
inserts, junk mail and telephone books), corrugated paper, magazines
and other periodicals, plastic containers (No. 1 through No. 7), and
other materials as may be designated from time to time as recyclable
materials.

RUBBISH
All combustible and noncombustible waste materials except
garbage, including the residue from the burning of wood, coal, coke
and other combustible material, paper, rags, cartons, boxes, wood,
excelsior, leather, grass clippings, leaves, shrubs, branches, yard
trimmings, Christmas trees, tin cans, metals, mineral matter, glass,
crockery, dust and similar matter.
TRADE WASTE
All garbage, rubbish, waste or refuse generated by a manufacturing,
commercial or business concern or by an apartment building which contains
more than three dwelling units.
B. Usage.
Whenever a particular time of day is specified, it shall refer to
the prevailing time system then in effect.
All garbage and rubbish, except trade waste, shall be collected
and disposed of from residences free of charge by the Borough or by
a responsible person under contract with the Borough. Contracts under
this article may from time to time be let to the lowest responsible
bidder after due advertisement first had by publication as required
by the Borough Code, which contract may contain in addition to the
requirements of this article such other provisions not in conflict
herewith as may be deemed advisable to incorporate therein, and such
contract shall be executed by the Mayor, President and Secretary of
Borough Council on behalf of the Borough. Such contracts may be let
for periods not to exceed three years and, at the discretion of Council,
may contain a provision requiring the successful contractor to give
a bond in such amount as Council may deem proper, with approved security,
conditioned for the faithful performance of the contract.
All trade waste may be collected and disposed of by the Borough,
provided the owner or occupant of the premises where such trade waste
originates or is produced agrees in advance to pay the collection
fees established by resolution by Borough Council. The contractor-collector
may also collect and dispose of trade waste, provided the cost thereof
is paid by the owner or occupant and not by the Borough. No trade
waste shall be set out for collection unless and until the owner or
occupant of the premises where the trade waste originates or is produced
has entered into an agreement with the Borough or with the contractor-collector
for collection and disposal of said waste.
Garbage and rubbish shall be collected from residences once
or twice a week, as Borough Council may determine when the Borough
is the collector or as shall be provided in the contract with any
contractor-collector. Garbage and rubbish shall be collected from
premises between the hours of 6:00 a.m. and 6:00 p.m.

The occupants of all buildings where garbage or rubbish is produced
shall provide and maintain containers for all garbage and rubbish
accumulated upon the premises thereof. A sufficient number of containers
shall be provided so that the aggregate capacity shall be sufficient
to store any garbage or rubbish accumulated between collections, but
in no event shall any one dwelling unit have more than four containers.
No garbage or rubbish shall be accumulated or stored upon any premises
or place for collection except in watertight and flytight containers
made of nonabsorbent metal or plastic materials. If a plastic container
is utilized, the garbage and/or rubbish shall be placed within said
container in plastic bags, and all containers, whether nonabsorbent
metal or plastic, shall be equipped with handles and closely fitted
covers made of nonabsorbent plastic or metal material which shall
be used in place at all times except when filling or emptying. These
containers shall have a capacity of not more than 39 gallons and shall
not exceed 40 pounds in weight when full. All refuse receptacles shall
be maintained in good condition and shall not have any sharp edges
or other defects which may hamper or injure handlers thereof. All
reusable receptacles shall be kept as sanitary as possible consistent
with the use to which they are put and shall be thoroughly cleansed
by the occupant after refuse is removed by the collector. All refuse
shall be drained of liquid before being deposited for collection.
All papers, cartons, boxes, barrels and crates shall be collapsed
and securely tied in bundles not exceeding 40 pounds. Tree trimmings
and brush shall be securely tied in bundles not over three feet in
length or 18 inches in diameter. All recyclable materials shall be
recycled and placed in recycling containers. Such recyclable materials
need not be separated into individual commodities (newspaper, glass,
plastic, etc.). No rocks, tires or any construction materials shall
be permitted inside of the garbage or rubbish container. It is specifically
prohibited to attempt to dispose of any hazardous waste or infectious
waste.
Refuse receptacles shall be placed for collection at sidewalk
level immediately adjacent to the curb. Except by express permission
of Borough Council, no refuse may be placed for collection at any
other location. The collector shall return the receptacle to the inside
of the curb and shall replace the lid or cover. The receptacles shall
not be placed by the occupant for collection earlier than 8:00 p.m.
of the evening or day before refuse is scheduled to be collected,
and empty receptacles shall be returned by the occupant to the household
premises before 8:00 p.m. of the day of collection. No person shall
place garbage or rubbish in any receptacle which has been placed for
collection by another person except with the express permission of
the owner of the receptacle.
The collector shall have the right to refuse to collect any
garbage or rubbish which is maintained, stored or placed for collection
in violation of the provisions of this article. It is the intent of
this article that the reasonable accumulation of refuse of each family
for the collection period shall be collected. The collector shall
have the right to refuse to collect an amount of refuse in any single
collection in excess of four receptacles per dwelling unit.

Bulk trash will be picked up from April to October on the last
Thursday of the month by appointment only or any other time that Council
deems appropriate. Refrigerators, air conditioners and tires will
be charged an additional cost to be determined by Council for the
Borough of West Conshohocken by resolution. Bulk trash items shall
not be placed on the curb side until after 6:30 p.m. on the last night
before the bulk trash will be picked up. The Borough will not pick
up more than four items of bulk trash per month. Bulk trash shall
not include any demolition, renovation or construction materials,
which must be removed by the contractor and not left on the curb or
sidewalk for disposal. All bulk trash items must not be placed anywhere
that would interfere with either pedestrian or vehicular travel.
Refuse collection shall be suspended on the following legal
holidays: New Year's Day, Memorial Day, July 4th, Labor Day,
Columbus Day, General Election Day, Thanksgiving and Christmas, and
no person shall place refuse along any street for collection on any
of these holidays. Refuse collection shall be suspended after any
snowfall of at least four inches until snowplowing of streets has
been completed, and no person shall place refuse along any street
for collection during such period.

Any person violating the provisions of this article shall be subject to the provisions detailed in Chapter
53A of the Code of the Borough of West Conshohocken.

This article shall be known and may be cited as the Borough
"Anti-Littering Ordinance."
No person, firm, corporation or association shall throw, drop,
or cause to be thrown or dropped upon any street or highway or other
public place or upon the land of another, any garbage, bottles, wastepaper,
cans, wood cartons, ashes, metal or metal sweepings, wire, glass,
handbills, cardboard, containers of any kind, mails, discarded or
soiled personal property, trash or rubbish of any kind, nor interfere
with, scatter or disturb the contents of any receptacle containing
garbage, ashes, household wastes or rubbish which has been placed
upon any sidewalk or elsewhere for the collection of the contents
thereof.
No person shall sweep into or deposit in any gutter, street
or other public place within the Borough the accumulation of litter
from any building or lot or from any public or private sidewalk or
driveway. Persons owning or occupying places of business within the
Borough shall keep the sidewalks in front of their businesses free
from litter. Litter retained temporarily on any premises shall be
stored in a suitable container.
