It is the purpose of this chapter to reduce hazardous conditions
resulting from the use of streets within residential areas for the
parking of vehicles by nonresidents; to protect those districts from
polluted air, excessive noise and trash and refuse caused by the entry
of such vehicles; to protect the residents of those districts from
unreasonable burdens in gaining access to their residences; to preserve
the character of those districts as residential districts; to promote
efficiency in the maintenance of those streets in a clean and safe
condition; to preserve the value of the property in those districts;
and to preserve the safety of children and other pedestrians and traffic
safety, and the peace, good order, comfort, convenience and welfare
of the inhabitants of the City.

The City Commission is authorized to designate by resolution
an area or areas of the City allowing residential uses in which parking
is restricted to residents of the area and their guests and, upon
discretion of the City Commission, to occupants (including employees)
of commercial buildings which do not meet Zoning Ordinance[1] requirements for the provision of off-street parking.
Such resolution shall specify the hours during which such restriction
shall be in effect. The City Commission is authorized to adopt regulations
for the administration of such designated residential parking areas.
A.
The City Commission may by such resolution:
(1)
Establish fees for a residential parking permit and a visitor's
parking permit and shall establish the guidelines for issuance of
such permits, including but not limited to determination of the number
of parking permits allowed to occupants of commercial buildings.
(2)
Establish criteria by which residential parking areas shall be evaluated
and approved including, but not limited to, demonstration of verifiable
hazardous condition or hardship, percentage of properties in favor,
standardization of days, time frames for ease of enforcement, and
other criteria and prerequisites as recommended by the Traffic Committee.
(3)
The criteria for the designation of residential parking areas and
the fees for permit parking are attached as Exhibit A,[2] which is expressly incorporated into this chapter by reference.

B.
Such hours and days as thus established shall be posted on signs
in the residential parking area so as to give notice to the general
public.
C.
No person shall:
(1)
Park in a residential parking area without a residential parking
permit or visitor's permit during the designated hours;
(2)
Allow another person to use a residential parking permit;
(3)
Falsify information to obtain such permits;
(4)
Fail to surrender his or her permit(s) on demand to the Chief of
Police, or his or her designee, if such permit(s) is used in violation
of this chapter;
(5)
Duplicate a residential parking permit; or
(6)
Otherwise violate the regulations governing the issuance of such
permit.
