This chapter shall be known and may be cited as the "Transportation
Safety Act."
The purpose of this chapter is to provide for the safe transportation
of persons and property with the intent of following the policies and procedures
of the United States Department of Transportation's Federal Highway Administration
as they relate to Title 49 of the Code of Federal Regulations and the North
American Standard Uniform Out of Service Criteria and Inspection Procedures.
References to the following terms in Title 49 of the Code of Federal
Regulations shall be construed to have the following meanings:
A. The terms "United States Department of Transportation,"
"Federal Highway Administration," "Federal Highway Administrator," "Director,"
or "Bureau of Motor Carrier Safety" shall be construed to refer to the Royal
Oak Police Department.
B. The term "interstate" shall mean intrastate or interstate,
or both, as applicable.
C. The terms "Special Agent of the Federal Highway Administration"
or "Administrative Personnel" shall be construed to mean a peace officer or
an enforcement member or a vehicle inspector of the Royal Oak Police Department.
The City Clerk shall publish this chapter in the manner required by
the Charter and at the same time shall publish a supplementary notice that
complete copies of the relevant provisions of Title 49 of the Code of Federal
Regulations as of February 28, 1990, are available at the office of the Clerk
for inspection by the public at all times.
Any driver or operator who violates a rule, or any owner or user of
any truck, truck tractor, or trailer, or any officer or agent of any individual
partnership, corporation, or association who requires or permits the driver
or operator to operate or drive any truck, truck tractor, or trailer in violation
of this chapter shall be subject to a fine of not more than $500 or to imprisonment
for not more than 90 days, or to both such fine and imprisonment, in the discretion
of the court.
