Any vehicle parked or abandoned on any portion or area of a public highway or place may be removed and conveyed by or under the direction of a member of the Town of Hamburg Police Department by means of towing the same to any public garage whenever:
A. 
Such vehicle shall be found parked or standing in violation of any town, county or state code or statute.
B. 
It is necessary to move such vehicle during or following a snowstorm to facilitate snow removal or during flood, fire, or other public emergency.
C. 
Any vehicle is found upon a public highway either driven or parked if it is being illegally operated or is illegally registered.
D. 
Any vehicle is found in a no-parking-tow away zone, when posted, on the following streets within the Town of Hamburg.

Whenever a vehicle is removed under circumstances set forth in § 185-1, such removal shall be at the owner's risk and the cost of removal and storage of any vehicle as herein authorized shall be a lien on any vehicle so removed and stored and may be connected by a public sale thereof.
Before the owner of a vehicle so removed and stored shall be permitted to remove such vehicle, he shall furnish to the Chief of Police:
A. 
Satisfactory evidence of identity and ownership.
B. 
A receipt from the public garage to which said vehicle was removed, indicating that all towing and storage charges have been paid.
C. 
That said vehicle shall be removed by and towed or driven by a person holding a valid operator's or chauffeur's license.
The Police Department shall keep a record of:
A. 
Owners of vehicles so removed and stored.
B. 
Other persons claiming the same.
C. 
License number of said vehicle.
D. 
Such other descriptive matter as may identify said vehicle, and the nature and circumstances of removing and storing said vehicle as well as they may be ascertained.
Nothing in this article shall be the cause for staying or preventing any prosecution of the owner or driver of said vehicle for the violation of any law or code on account of which said vehicle was removed and stored.

The parking of vehicles is hereby prohibited within the right-of-way of any county or Town road within the Town of Hamburg, exclusive of the Villages of Blasdell and Hamburg, between the hours of 1:00 a.m. and 6:00 a.m. from November 1 to March 31, inclusive, in each year.
As used in this chapter, the following terms shall have the meanings indicated:
PARK AND STAND
The stopping of a motor vehicle or motorcycle or any vehicle at the places restricted, unattended by a person capable of operating it, for a period longer than necessary to load or unload passengers or freight.

Any person, firm or corporation permitting any vehicle to remain parked or standing on any street contrary to the provisions of this Code shall, upon conviction, be punished by a minimum fine of $50 and a maximum not to exceed $150.
This chapter shall take effect immediately upon publication in accordance with the provisions of the law applicable thereto.
