The words and phrases used in this chapter shall, for the purpose
of this chapter, have the meanings respectively ascribed to them by
Article I of the Vehicle and Traffic Law of the State of New York
unless as otherwise defined herein.
COMMERCIAL VEHICLE
A truck, bus, school bus, omnibus, taxi, livery or any other
vehicle used for commercial purposes where such other vehicle bears
interior or exterior identification or indication of commercial use.
Examples of identification or indication of commercial use include
but are not limited to commercial license plates or any sign or placard
indicating the name, address, telephone number or nature of the commercial
enterprise that is visible on either the front, rear, roof, bed, interior
compartment or either side of the vehicle and/or any ladder, rope,
cable, plow, tool, machinery, equipment, container or other items
utilized in the commercial enterprise and affixed to the front, rear,
roof, bed, interior compartment or either side of the vehicle.
CURBLINE
The prolongation of the lateral line of a curb or, in the
absence of a curb, the lateral boundary line of the roadway.
HOLIDAYS
New Year's Day, President's Day, Martin Luther King, Jr.,
Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans
Day, Thanksgiving Day and Christmas Day commencing 12 hours prior
thereto.
LOADING
The actual moving of persons, merchandise, goods or cargo
into or out of a vehicle, but excluding standing or waiting time.
MARKED PARKING SPACE
An area on a street or within a municipal parking lot designated
for the parking of a single vehicle by lines painted or otherwise
durably indicated upon the curb or surface of the ground.
MUNICIPAL PARKING LOT
Any area within the Village designated as such by this chapter
and the entranceway and exits therefrom.
OFFICIAL TIME STANDARD
Whenever certain hours are named herein or on traffic control
devices, they shall mean the time standard which is in current use
in this state.
OVER-SIZED VEHICLE
Every vehicle having an overall length of more than 21 feet
or an overall width of more than eight feet or an overall height (exclusive
of aerials or similar accessories) of eight feet. All such dimensions
are inclusive of loads and attachments.
PARKING or PARKED
The stopping of a vehicle, whether or not attended or occupied,
for any interval of time longer than necessary for loading.
PERSON
Any person, firm, partnership, association, corporation or
other entity.
RESIDENTIAL STREET
Every street located in a residential zoning district as
defined in the Town of Harrison Zoning Ordinance then in effect. Where the division line between a residential and nonresidential
district is located in whole or in part between two consecutive street
intersections, the entire length of street between such intersections
shall be residential. Where the division line between a residential
and nonresidential street is located in whole or in part between the
opposite curb sides of a street, only the curb side of such street
which is wholly or partly within the residential district shall be
the residential district.
STREET
The length of roadway between any two consecutive road intersections
or between a road intersection and the end of a road if there be no
intervening road intersection and the entire width of the boundary
lines of every way publicly maintained when any part thereof is open
to the use of the public for the purposes of vehicular travel.
TRUCKING
The operation of all motor vehicles, trucks and buses, either
carrying or used in connection with the carrying and transportation
of all kinds of freight, dirt, rock, brick, stones, building material,
manure, fertilizers and similar substances, or operating the same
thereupon without such cargoes or substances, except when the same
are engaged in actually carrying and transporting such similar materials
to and from any property, building or place located in and upon said
street, highway or portion thereof, for the purpose of loading or
unloading same.
VEHICLE
Every device in, upon, or by which any person or property
may be transported or drawn upon a street, except devices moved only
by human power.
